    Yeah. Its a private business, not government. Freedom of speech prevents you from getting slapped down by the government, it doesn't prevent you from getting slapped down in the private sector.

    surely you've been checking other media outlets besides this thread. maybe google search "donald sterling knew he as being recorded"? do you come to clutchfans for all your facts?

    Even if he did not know and the recording was completely illegal, it still doesn't matter. The NBA Board of Governors is not a court of law. They don't throw out information because it was obtained improperly. Aside from which, it wasn't the recording that got him tossed (if they heard it but no one else did, would they have done anything at all?), it was the fact it was plastered all over the news. His crime against the NBA is not being a racist, but letting everyone know he is a racist.

    Was it a spiteful ex-girlfriend looking for revenge. Yes, of course. The Sterlings were suing her to recoup gifts Sterling gave her during their affair. She saw a way to cause him trouble, and succeeded in grand fashion. That it was a revenge plot doesn't mean we shouldn't go along.

    And, I'm surprised so many people are wringing their hands over Donald Sterling. We've long known him to be not only a terrible person but a terrible owner. A recent spate of good luck in picking up Griffin and Paul doesn't begin to make up for 3 decades of terrible management. Even if he wasn't a racist, the league is better off without him. Until contention fell into his lap, he never tried to win.

    Mark Cuban is such a tool.

    The other day he said these things about slippery slopes.

    "Again, there's no excuse for his positions. There's no excuse for what he said. There's no excuse for anybody to support racism. There's no place for it in our league, but there's a very, very, very slippery slope."

    He said forcing Sterling to sell would be un-American:

    "But regardless of your background, regardless of the history they have, if we're taking something somebody said in their home and we're trying to turn it into something that leads to you being forced to divest property in any way, shape or form, that's not the United States of America. I don't want to be part of that."

    Those two positions are not contradictory. The commissioner didn't force him to sell the team I'm sure Cuban supports the lifetime ban and will vote against forcing him to sell.

    Silver did not say he will force the sale of the team. (he cant by nba by laws) Silver said he will hold a "vote" for the board of governors/owners if Sterling should be forced to sale.

    Well, to be fair, Cuban pisses me off, but it's quite possible that he was presented additional information about the situation- maybe that's what he meant by the Commissioner's findings- and remember, Silver said that he was going to talk to Sterling about this, which I'm sure he did- so, yes, I'm defending the owner of a Dallas sports team. Now if you'll excuse me, I need to go hurl. :grin:

    I didn't look at Sterling as a first time offender. We just caught it on audio. You understand this was far deeper than what happened here. This started a long time ago. The NBA is doing what they should have done years ago. Not to applaud or pat him on the back, Silver did his job.

    He knows that after this decision, if he does not go along with it, it will damage his image.

    If the owners voting is made public, every single owner will vote to kick Sterling out of the league.

    Is anyone willing to clarify this with a link?

    It's all fine and dandy the NBA made a strong decision due to SOCIAL MEDIA, despite this being tame compared to the evidence against him over the past few DECADES, but for legal reasons I want to know how they can justify using the tape to indict him....

    Mark Cuban doesn't believe the NBA has the right to strip the franchise from a man because of his beliefs and a conversation he had with his GF? We don't like THAT belief either! Vote him out!

    Right, he supports Silver's attempt to force Sterling to sell the team but won't vote for it. That's great. That's like endorsing a candidate for political office and then voting for his opponent.
