So, my roommate and I got in an argument and I ended up calling her a skank b****. She told the landlord and now he wants to evict me. Can a landlord in Texas really evict me (I have a lease) for name calling?

the landlord can kick you out for whatever reason they want. Its their place.

All of this ignores what the contract says, but i am sure the landlord reserves the right to kick you out if u annoy other occupants.

They can evict you for whatever reason they'd like, however you can fight it. The law is in the tenant's favor, I'd familiarize yourself with the Texas eviction process.

Check the fine print on your lease. I doubt that there is anything in there which specifies that those are grounds for eviction. If the landlord insists that you leave, make sure they put that in writing and have them specifically state the reason for your eviction. If they ask why, tell them you will need that letter to for the housing authority of Texas. I bet you, they back off.

no they don't. unless there is a breach of contract, they cannot kick you out whenever they want especially if there is a signed lease.

Eviction isn't something that just "happens" by the way, it is a very long and drawn out process. It sometimes takes months for property owners to get deadbeats who don't pay out... and at least a 30 day notice of eviction is required, regardless of reason.

The act of evicting is easy, they can do it for whatever reason they'd like... it is really no different than a lawsuit. However, the court can and does throw out frivolous eviction cases all the time. It is a big process, and the eviction can be overturned throughout the process.

He's not saying the law is on his side, he's saying the landlord has every moral and ethical right to kick anyone out they want to. It's their house and it's freedom and 'MURICA.

Maybe someone is being a little to liberal with the "roommate" word. Did you insult your mom and now your parents want you to move out?

It depends. By him insulting his roommate it could be seen as making the unit unlivable for the roommate. In doing that the OP has breached the contract and can be evicted. It's like if your landlord does not provide certain repairs like fixing windows or doors, you can sue for previously paid rent and even break your lease with no penalty if they will not make said repairs.

I agree with most of what you sadi with the exception of 'moral'. There is nothing moral about leaving somebody homeless for the simple reason of "just because". There is a contract and both parties are obligated to abide by those. There is nothing moral about not honoring an agreement.

No you cant insinuate that. Unless it states specifically on the lease that you cannot bad mouth your roomate, you have not broken any terms of the agreement. If the roommate does not feel comfortable living with him, that roommate has the choice to leave. But the owner does not have the right to kick him out just because he is siding with the other person.

Do you live in an apartment, condo, or room in a private house? Does the landlord live there too? Was there an official lease or just a general living arrangement?

It's calling a woman a skanky b****, that could be likened to a threat. Regardless, if he is seen as the instigator of an intolerable living situation he can be evicted.

I'll put it to you a different way, if I wanted my roommates to leave under your understanding of the law all I had to do was annoy them to death until they were forced to find a new living situation. I could call them names, scream at them, and just making it bad for everyone there and my roommates would have no course of action according to you. There is no way the law would be set like that.

The real question here is what kind of grown adult runs to the landlord to tell on their roommate after an argument? Is there more to the story than you're telling us, or is that really all there was? Is there a history of past occurrences that you aren't disclosing?

You're giving too much credit here. How many grown adults do we actually have on cf.net?

You picked a real gem of a roommate. Or you need to stop swearing at your mother.
