The Astros haven't complained about the $40MM they haven't received. They didn't file the bankruptcy or make any kind of demand for the payment.
They have brought it up that's for sure. The reason it's not as big a deal to them is that crane has dropped the payroll so low he can ride this out on the 40% and still make money. Meanwhile the team stinks so bad flies have to wear clothespins on their noses to land on MMP.
The team was terrible when he bought it. The farm system was the worst in baseball and by next year will be the best or at a minimum in the top 3-4 in baseball. They almost landed Jose Abreu as well. It is stupid to spend money when you have no chance to compete. I have no good an owner he will be. Hell when John McMullen bought the Astros the perception was he was a great owner, only later was he a cheap b*stard. You don't have to like the Astros or their owner, but your comments border on the absurd. I don't know if Crane dropped his meat hammer on your wife or worse, but your level of hatred is not healthy.
It was brought up in the initial filings by the Comcast Creditors. They brought it up to say the payments hadn't been made and that the Astros were 3 days away from walking the deal, in accordance with their rights under the broadcast agreement. They brought that up because they're saying they need the automatic stay provisions of bankruptcy to keep CSN's biggest asset from walking out the door.
I think his point is they're not making a claim for their money in this bankruptcy...they'd rather walk.

OMG...you mean they were going to exercise their rights under the contract that everybody agreed to? Oh the humanity. Frankly, if I saw that the revenues from the proposed carriage agreements were not going to support what I was promised under the deal and I had not been paid in three months...I'd walk too. That's called knowing when to cut your losses.

You claimed they demanded their money - they did not. They've never asked to be paid that money, as far as we know. Instead, they were content to just exercise the mutually agreed clause that allowed them to walk, presumably because they realized this thing is a disaster and were content to eat the losses and start over. Comcast is the one that didn't want that.
Mentioning facts in a bankruptcy filing is different than asking for that money to be paid. They are the facts of the case and have to be mentioned. Notice that in the part you quoted, they never ask or demand payment. You writing in big bold font doesn't change that.
