    Well it wasn't a complete rebate so no, Fox Sports is not free to the providers.

    I haven't read anything definitive on that point at all. I know that Hutchings with CSN was arguing that there was a rebate out there, though. I think Tad Brown got on sports radio one morning and told people to call their providers to make sure their bill reflected the rebate.

    Not paying was a calculated move to break the impasse knowing full well the Astros would walk and then hopefully get a trustee in bankruptcy court to fix this mess. You do know that, right? You do know the Rockets were onboard with this with the caveat that the threat of a trustee might make Crane come to his senses?

    But we haven't been offered up proof that this rebated cost still isn't playing a factor to any degree.

    Newest document filed is a Stipulation. Astros and Comcast stipulate that the testimony of the VP of Finance and HR for CSN-H would testify that for each of the following petitioning creditors:

    1. Comcast Media; and

    2. Comcast California

    various invoices were received.

    That each of those invoices:

    1. is not supported by a written agreement obligating CSN to pay;

    2. that all parties agree that there is an obligation to pay, and that typically both of those creditors accepted payment 40-60 days after the invoice date with no objection; and

    3. that every one of the invoices was either paid as of October 22 or is in processing and payment will be completed shortly in accordance with the 40-60 day standard.


    Reading this, it sounds like the Astros are going to be saying: "See! There's no reason to afford bankruptcy protection to the petitioning creditors, as they're all being paid in the ordinary course of business. CSN-H isn't bankrupt as defined by the Code because it's able to meet its obligations as they come due."

    I know that exactly. That's why I agree with the position that the case should be dismissed...because creditors are being paid..and the only one that isn't being paid is the Astros, not because the money isn't there, but because Comcast is trying to force a bankruptcy proceeding and the appointment of a trustee that neither of its partners want.

    My point is only that it's a huge risk. If the bankruptcy court dismisses the case...and the asset walks out the door, then Comcast has sunk $100 million into a sinking ship.

    Must you be so condescending by the way? I'm happy to have a discussion with you...but your tone always comes off like you have a chip on your shoulder. I haven't given you hell.

    You realize this and basically admit that everyone is doing what is best for their own organization without much regard to the others, but still think the Astros are the bad guys and everyone else are the good guys?

    I think the Rockets do want it if the one week negotiation does not bring closure. They'd just prefer it not come to that.

    I'm no expert, but if I remember correctly an Exhibit List is a list of all Exhibits that a party may use at trial. These lists are required by the courts before trial, and they usually have to be done jointly with opposing counsel. Often the courts require that the parties agree to foundation and admissibility ahead of time to the extent possible to so that the trial proceeds efficiently.

    But that's just off the top of my head, because I know of no way to search for that term to see what it means exactly.

    Also could be a list of an individual's favorite Xzibit songs.

    i listened to the astros on radio and the rockets last season on radio. love craig ackerman, i felt like something happened in my family when he experienced tragedy last year.

    i listened to astros on radio. i listen to 790 all day aside from a couple of political shows. its on as i sleep so i know things like how well the farm system is doing, and that drayton didn't sign prospects he drafted and traded others depleting the system over the last few years.

    i think crane has spent money on the team, a lot, in the minor leagues. i think the $76MM will actually be more like between $40MM and $50MM once looking at payments he didn't receive.

    lastly, i like listening on the radio it doesn't bother me, it allows for other more important things getting done. so i have no dog in this fight, i'm basketball more than baseball but have followed the astros since i was a kid so i still keep up with them.

    Nearly everyone in this discussion has called you out for your behaviour in this "debate". And you can book it: every time you resort to calling people "homer" and questioning their reasoning capacities when their points of view differ from yours I WILL call you out for that bull****. If you don't like it, click the ignore button. Or maybe, just maybe, learn that other points of view can have merit.
