I understand what some of them are saying though. There is a risk when getting blackout drunk around a bunch of horny high school football players. There is a risk if a girl wants to get blackout drunk at a frat house as well. She didn't deserve to get raped, and she doesn't deserve a ticket for a minor under the influence because she already paid the price for her actions. But she did put herself at risk by drinking as much as she did.
I think in JD88's case, he would be partly to blame. If you leave valuables on your lawn, there's a reasonable chance they will be stolen. I think if 100 people did that, a decent number of people would have stuff stolen (say, 10%). However, in the case here, gangrape is not a reasonably likely consequence of getting wasted. If 100 people get wasted, I don't think 10 of them - or even 1 of them - are likely to be gangraped. Especially when done in a public setting, where you'd think just ONE person would be needed to stop it. At some point, reasonable likelihood has to be a factor. If I stand out in the middle of the street and get hit by a car, that's partly on me because that's a reasonably likely outcome that I should have been aware of. If I stand out in the middle of the street and get shot by a random gang shooting, I'm not at all to blame because that's not something I reasonably should have been worried about.

BUT, you can just take the attitude of her being a sweet innocent rape victim. The girl is 16! 16 years old! Passed out drunk! I thought the legal drinking age was 21? So lets get this straight, a 16 year old girl was passed out drunk around a bunch of horny young guys and she got raped? When you say it like that it doesn't sound surprising. However, that's no excuse for rape, at all. Those guys should be in jail forever, I agree. But the girl can't just act like she was not at fault at all.
look at the point is the girl shouldn't have gotten that drunk BUT... the RISK of rape should NEVER be there. if someone wants to get that drunk and fk up their body..that's one thing..but that is NEVER NEVER an excuse to say rape is EVER ok. i feel like some of you are saying: rape = wrong, terrible rape when stupid drunk = well..hmm..that's the risk. uhm?
I've read through the last couple of pages and I understand JD88 and Shaud's point but I think they might've phrased them wrong. The blame for the rape solely lies on the rapists but if we are talking whether the girl behaved responsibly in the first place I think it is very reasonable to say that a 16 year old girl getting drunk to the point of blacking out isn't responsible behavior. This is obviously a very fine line how this is presented but probably the most important point of self-defense is learning how to avoid situations that could potentially put you into harm. In a case where someone attacks somebody the fault is on the attacker legally and morally but for your own personal safety situations where you might be attacked should be avoided.

I think rocketsjudoka is giving their argument way too much credit. The implications are clear. This type of subtle shaming of the victim is why rape is one of the most under reported crimes. This thread was awful to read.
I agree that (unfortunately) there is a reasonable chance the goods would be stolen. That being the case, I still feel that the thieves are 100% to blame. If the case were to go to trial, the thieves should still get the maximum penalty and not be able to use "the stuff was on his lawn" defense. We had two cars stolen out of our driveway when we lived in Houston. One of the questions the insurance company asked us was "why weren't they in the garage?".

Shaud: Anyone who thinks this girl isn't somewhat to blame for what happened to her is wrong. ... If they drugged her I agree she doesn't deserve any blame but if she was just wasted from drinking too much some blame is on her.
