    And in the example that he mentioned, which happens all too often, the abused victim who gets the guy off is dead the 2nd time around because the judge "heeded" the opinion the 1st time.

    The judge should rule based primarily on the facts of the case.

    If there's one thing that unites Americans, it's the desire to throw people in cages.

    This, in contrast to many "crimes" is actually a real crime. But I just think 3 years in a jail won't make anyone in this story better off.

    On a 1st offense? Depending on what actually occurred:

    Armed robbery
    Murder
    Manslaughter
    Aggravated assault
    Aggravated battery
    Rape
    Child molestation

    I'm sure others, and everything has to be treated on a case to case basis, as I said before, the charges can often sound much worse than what actually went down.

    as harsh as this sentence is on this kid...time in jail...might help him value relationships...jail, as many say, helps people think...

    Now for the idea that the girl didnt want him to get jail sentence...well thats not up to her to decide...in the end...the young man decided to plead guilty and he was faced with the chance at going to jail...

    there might be a chance that the judge reduces the sentence after 6 months...

    He has learned the hardest lesson of all...hopefully he comes out on top...

    We can't stop people from committing a 2nd crime short of killing them. If indeed he is going to kill someone, great, you've made it more likely to occur by sentencing him to an extended stay in prison, and only delayed it from happening by 3 years.

    They should rule primarily on the facts, but that doesn't mean additional consideration should be given. Pulling hair vs. putting someone in the hospital would obviously be different.

    Court ordered anger control and classroom requirements would make sense. Something that helps better the young man and society.

    Where did the judge say he was beating her while she was in a corner. Go ahead and find that part for me. Otherwise, that was a complete assumption.

    There are different levels of mistakes. Rape can't be rationalized, but yes assault can be.

    I understand because I've made mistakes.

    It's probably one of those judges that gets paid to send kids to jail. 3 years is too harsh.

    I didn't say it was, but I was responding to the post saying juveniles can be tried as adults. And I find it amazing one arbitrary year in a person's lifetime makes the difference between 6 months of probation and 3 years of prison.

    From kicking to hitting. Since this is a quote, I'll assume that is what she said, though kicking is a form of hitting, it isn't likely to occur without injury. Slapping I could see.

    I really wish I could see the video.

    Perhaps the injuries were more severe than the articles lead you to believe. Curious to why most articles focus on him pulling her by the hair, rather than kicking her in the head, which sounds worse.
