    yea... i have a uh....friend who used that particular service a lot. Will this friend be getting a letter from the govt anytime soon?

    Probably because entertainment for most people is to waste/kill time. If they weren't getting it for free, they would do something else that was free (watch tv). A very small percentage would actually pay for what they are downloading. Or just do Netflix and watch it a few weeks later.

    lol, no. If your friend was not running the servers, putting in the code or was part of Demonoid's inner circle nothing is gonna happen. Trackers get taken down all of the time. I had over 2000 uploads to OiNK was taken down and nothing.

    There is nothing inherently illegal about using a tracker site. It is not the technology; it is a matter of what you download/share.

    That's why it is very hard to charge someone, because there not only must be proof of 1) you infringed upon a copyright (only possible by matching your IP to a swarm, trackers don't save swarm data), 2) they must prove it was you did it using that IP, and, finally, 3) you are innocent if you own the viewing rights -- which is often the case for me.

    #3 means I own HBO or some DVD and the HBO replays have ended and I want to rewatch a season that I already paid for. Or for DVDs, I either can't find it or not at home to use it. This falls under the right to make backups or record episodes...sharing technology does not make something illegal by itself, if I already own the viewing rights.

    Also note: court precedent has said trackers are innocent since they don't have the data. Torrents are merely "an invitation to download." Not so sure a tracker can be beaten in US court unless they actually store copywritten data knowingly...a torrent tracker is not data.

    Those running the trackers servers are often the most innocent of anyone involved. Trackers are taken down, but how often do they actually get charged.

    The servers must actually store the copywritten material. A tracker is not data. Court precedence found that a torrent is merely "an invitation to download/share files." But the files need not be on the tracker server...and usually are not. They are scattered throughout the world in a swarm of P2P machines.

    Usually (with smart tracker sites), they do not ever touch the real files. They just index the torrent files that are available...and torrents are not source data (they just are a record of the number of pieces in a file...hence why they are only 15k for a 500mb file).

    I have friend who pays for netflix but still downloads stuff. It's like he is addicted to downloading and posting cn a houston basketball forum! I swear....

    ah so I see.. Obama and his movie star / studio's BFF's get's around the legalities of hiring hackers to create a massive DOS and scrambling of demonoid data by getting his new BFF's in the Ukraine to do the dirty work. All the while he can wash his hands since he didn't actually do anything..(since that would be illegal in the US) It was just a gift from the Ukrainian PM for their intellectual property rights get together. I'm going to assume movie night for the Ukrainian PM and cronies will last a while after confiscating everything from Demonoid. So when has the Ukraine been so concerned about intellectual property? They are usually as bad as the Chinese or worse.


    I remember hearing of a torrent site moving into a NATO bunker.. whatever happened to that one? Since the bunker was on sovereign land, no one could do anything to them. Edit: actually found the article but it was PirateBay.

    Taking down downloading sites like Demonoid is just stupid. I think the government is trying to send a message, which is fine since there are a lot of Hollywood lobbyists in Washington trying to get the government to crack down on piracy. The fact is, as long as the Internet exists, there will always be piracy. But studies have also shown that piracy may not necessarily lead to big profit loss as claimed by the studios.

    Sometimes studios will even "leak" screeners of some crap film on the Internet just to get interest and buzz going. Eventually, word of mouth may actually get some sucker to go and buy/rent it. Furthermore, there are people who download music albums and have decided it's good enough for them to purchase later on. I personally think it's just a game the government plays to send a message. If it really wants to shut torrent sites down, they would need to come down a lot harder.

    My understanding is raiding the servers isn't going to provide this information. The tracker does not store the P2P transfer info. Think about it. The tracker does nothing but points the swarm to each other, then clients like Azureus and what not take over from there, between seeders and leechers.

    A smart tracker site would never store any info it doesn't need. It doesn't need to know how much someone has d/l'd or uploaded in a month. It just needs to know how to connect a swarm, and efficiently direct traffic to file pieces to maximize swarm speed. But it doesn't need to store that info.

    Some of the membership trackers require you to seed for a length of time or ratio. So they have to store you seeding per torrent, but could discard it. That would possibly be info that can indirectly measure your usage. But TPB doesn't store that.
