    MONTGOMERY COUNTY, TX (CBS ATLANTA) -

    An honor student in Texas was thrown in jail after she missed too many classes at her high school.

    A judge issued Diane Tran, 17, a summons Wednesday for her excessive truancy after she missed class. She was arrested in open court.

    Last month, Tran was issued a warning by the judge for missing school.

    Tran said she works both full-time and part-time jobs, in addition to taking advanced and college level courses.

    But the judge said Tran's case was bigger than the individual situation of one student.

    "If you let one run loose, what are you gonna' do with the rest of 'em?," said Judge Lanny Moriarty. "Let them go too? A little stay in the jail for one night is not a death sentence."

    But Tran's classmates said she had a lot more to juggle than the average teen.

    "She goes from job to job from school. She stays up until 7 a.m. in the morning doing her homework," said Devin Hill, a classmate and co-worker.

    On top of that, Tran said her parents spilt up and moved away, leaving her to support her younger sister.

    The judge admitted that he wanted to make an example of the teen. Tran had to spend 24 hours in jail and pay a $100 fine.

    Shouldnt hightop be complaining about the judge? What does this have to do with schools unless he thinks checking attendance violates personal freedom. (good luck selling that argument to parents)

    I have seen kids never miss a day of school but they are completely worthless.

    He is missing the big picture.

    Gonna disagree with the majority here. We have to have a mechanism for punishing truancy, sure her rationale is good and I guess we are assuming that she is keeping up with her schoolwork. Probably even one night in jail is a little excessive, but if we allow anyone to prioritize work over school it could have negative consequences for other kids.

    What kind of parents would just abandon their children like that? They are the ones who should be punished.

    I missed that last sentence about her parents having moved away. Perhaps THEY should serve a little jail time. Even if 17 is an adult in Atlanta her younger sister is not an adult and the parents should be punished.

    Shouldn't a minor taking care of siblings on her own be a CPS/Social Worker situation? If not couldn't she get some kind of welfare to prevent her from having to work two jobs and miss school?

    I wish I had the magical power to travel to the world you actively imagine just so I could spend fifteen minutes there to witness the chaos and misery that surely prevails and then travel back and relate what I saw to everyone else.

    I suppose I could always just go to Haiti.

    Damn dude, you misread the article and laid fault on the girl. You then mistaken a suburb of Houston as Atlanta. Slow down, lol.
    If the facts presented in her case are accurate, then that judge is an ass.

    Edit: What's annoying and stupid about this situation is that the judge is saying that not jailing her would be letting her run loose. WTF? She's not truant and running around causing problems for society.

    Just another example of ridiculous judges failing to give citizens their due process, that is to judge their case individually and assess their punishment appropriately. The same reason I believe mandatory min. sentences are unconstitutional.

    I thought that there were laws that limited the amount of hours a student under 18 could work? There are a lot of things in this story that don't add up.

    However this judge needs to be fired.
