    Apparently you can see the Frost Giants in the trailer. Kind of meh.

    You mean the guys jumping from the sky off something? They don't look like Frost Giants to me; they look like aliens. If my understanding is correct, there will probably be both in the movie.

    They could stand to treat him/his estate better....but I'm inclined to agree with the legal ruling and general stance. It was his job to create characters for Marvel/DC. You would have copyright/royalty chaos if every creative member and writer claimed characters/ideas from projects. "I was the one that came up with the idea of Bruce in Nemo!" "I was the face of the Hulk, and therefore I'm entitled to a cut of merchandise bearing my likeness!" etc.

    IP can be a thorny subject, and most companies have everything spelled out when you sign the contract. It's not the same as a musician cutting an album for a record company (unless they signed a horrific deal giving the studio all the rights to the songs).

    I find the idea tough to believe:
    How would the Frost Giants all of a sudden be flying around in high tech spaceships? They hang around with freaking ice clubs!

    I'm far more inclined to buy into the idea that Kang is summoned from the future or that Loki will accidently "create" Thanos (revise the origin and let him be a random alien that gets a hold of the infinity gauntlet....for the Avengers sequel)

    agreed. He was an employee of marvel and was paid to create, which he did. He didn't bring those ideas to Marvel as a freelancer

    He didn't sign a contract - he was bullied into it and under terms that any reasonable person would find abhorrent. The guy couldn't even get his own artwork back or show the pieces he did have. That's not business - that's criminal and the judge should have thrown the contract out given that it was signed under duress

    Furthermore, if you know anything about the creative process, you would know that most "ideas" are germinated over a long period of time. More than likely, the images of the Marvel heroes originated in Kirby's pre-Marvel drawings. Once Kirby joined Marvel, he had a forum to further develop these ideas. Yes, I'm speculating, but this trend appears over and over again when you look at the lives of artists and other creative persons. It's too bad our laws (and the judges) have such a narrow and frankly inaccurate view of creativity.

    The fact that Marvel has made Stan Lee a multimillionaire but left the artists (the ones who truly create comic heroes) out to dry is despicable and it shouldn't be tolerated. I can't do a thing legally, but I can make damn sure Marvel never gets another dime off of me. And it really bothers me that people can be so dismissive of such amorality. You wouldn't treat a friend this way but yet it's okay to treat a neighbor or coworker as such.

    I totally agree with your post. Which really comes down to fandom vs. morals. But it's hard (coming from the fans perspective) to just give up the opportunity to enjoy what every person used to dream about as they were children enjoying these action heroes.

    It's really just the nature of the business, I mean how many countless other claims have gone thru under the media eye similar to this one. I really feel for the creators getting snubbed while some blowhard of a person gets all the rep and glory.

    I'll still be seeing the movie unfortunately. :(

    I guess artists are expendable. If they want too much, there's always a less demanding replacement waiting for the spot. Like an NFL running back.

    In the final scene where they are making their "last stand"...LOL at Scarlett Johanson with just a hand gun. If only she would get naked in this film, I could look past how ridiculously useless that made her character look in what appeared to be the biggest action moment of the film.

    OHHH my...i love super hero movies and i think i just wet my pants. I'm hoping for a ton of action scenes.

    I like the trailers...but it's hard not to believe that they're still showing us numerous scenes that are incomplete (digital alien troops to be inserted).

    I get what you're saying...but that's going to be how it is as an employee of any company. What you create for the company is the company's unless you joined up with the leverage to hold IP rights.

    The mafia didn't come to his house and draft him as a Marvel employee and nothing prevented him from walking away (which he did...only to come back after a flop with Fourth World).

    Todd McFarlane and Jim Lee broke off from the big dogs and created their own characters. It's a big risk, it is an incredibly tough business to break into, but it's an option. Nothing prevented Kirby from starting up his own comics line...but maybe it also speaks to the enormous difficulty of getting one off the ground.

    Yeah, they could have given her something a little more substantial. In general, her and hawkeye just look out of place..could he not find some sleeves?

    I also liked Captain Americas outfit in his movie better what I saw there.

    Still, it's going to be cool to see all the dynamics come together in the movie

    Yea its kinda ridiculous putting Hulk, Iron Man, and the Capt with a bow and arrow boy and pistol girl.

    But otherwise that trailer looked badass.

    Putting Hulk with anyone is ridiculous. (And mercifully the comics agreed he left the Avengers anyway)

    EDIT: Watching the trailer I note that Hulk looks Ang Lee cheesy again and reminds me that I loathe their decision to not use Norton.

    I was just trying to show the Capt some respect, because he's the Capt. But yea, he'd be no more effective than Batman in full-scale alien invasion. Which is to say not particularly.

    It's just like anything else, you have your all stars and your role players. Without your role players, you don't have a team. Obviously your heavy hitters are Hulk / Iron Man / Thor, meanwhile Cap is your team captain / shane battier type (intangibles!), Black Widow and Hawkeye have their place. Although if I was making Avengers I might have talked to War Machine, but apparently he's useless in the face of an alien invasion.
