    To add engaging in or supporting hostilities against the United States to the list of acts for which United States nationals would lose their nationality.

    IN THE HOUSE OF REPRESENTATIVES

    October 12, 2011

    Mr. DENT (for himself and Mr. ALTMIRE) introduced the following bill; which was referred to the Committee on the Judiciary

    A BILL

    To add engaging in or supporting hostilities against the United States to the list of acts for which United States nationals would lose their nationality.

    Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

    SECTION 1. SHORT TITLE.

    This Act may be cited as the ‘Enemy Expatriation Act’.

    SEC. 2. LOSS OF NATIONALITY.

    (a) In General- Section 349 of the Immigration and Nationality Act (8 U.S.C. 1481) is amended--

    (1) in subsection (a)--

    (A) in each of paragraphs (1) through (6), by striking ‘or’ at the end;

    (B) in paragraph (7), by striking the period at the end and inserting ‘; or’; and

    (C) by adding at the end the following:

    ‘(8) engaging in, or purposefully and materially supporting, hostilities against the United States.’; and

    (2) by adding at the end the following:

    ‘(c) For purposes of this section, the term ‘hostilities’ means any conflict subject to the laws of war.’.

    (b) Technical Amendment- Section 351(a) of the Immigration and Nationality Act (8 U.S.C. 1483(a)) is amended by striking ‘(6) and (7)’ and inserting ‘(6), (7), and (8)’.

    Anyone know what the 'laws of war' are?

    It is obvious this is the NDAA's counterpart and this is some scary stuff, Thomas Jefferson said it best

    'Those who give up their liberty for security deserves nothing.'

    Why is this hitting the fan now? He posted it in October.

    But anyway, yeah I find it appalling. Any branch of the government can accuse me of "supporting hostilities" and remove my citizenship? Is sending a nasty letter to a rep supporting hostilities? Marching in a protest? Exchanging email with someone the government doesn't like?

    Yikes.

    The current Supreme Court, half now being extremists, thanks to Republican Presidents, threw out several decades of established law to declare that a corporation is a person. That's adding a "citizen" who isn't a human being. That trumps whatever nonsense is posted in this thread, in my opinion.

    What are you talking? Corporate personhood is as old as modern capitalism - the latter really couldn't work without the former.

    I would like to see an article from a real paper about it, but couldn't find one. Anyone have one?

    I don't disbelieve that the Feds would try to pull a stunt like this. I'd just like some context for the laws of war business. That's so brief that it'd seem to me that the President would just decide what counts (and no doubt cite national security to deny access to the supporting facts). Regardless, I don't think I'm interested in a law like this, nor indefinite detention.
