$1,000 Fine From Landlord for Having a Party

    Apparently my landlord invoked a clause in my contract that says he can charge us a $1,000 fee for having more than eight people in our apartment at any time. We have five people living in our place in Austin and had some friends and family staying. There was no party. Any suggestions on how to go about fighting this? Is this even legal in Austin/Texas?

    Did he just assume this, or does he have concrete evidence that more than eight folks were there?

    Not much you can do if its in a legally binding agreement.

    Sounds like someone maybe reaching if it happened how you say it did, but how else are they going to pay for their iPad this Christmas.

    I dont think it matters if it was a party or not because you're saying the problem was the # of people.

    here are some resources statewide and austin based. according to the third link below, there are occupancy limits- three times the amount of bedrooms in the unit, but I dont see anything about guests.

    we have a two guest limit as far as amenities goes(pool, fitness center, rec room) I have no idea what the fine or punishment would be, it is just frowned upon by mangement. we asked specifically about get-togethers in the unit and the rule does not apply. I live in CA

    it's true, this is the first time in the history of Austin Texas where at least 5 people have dwelled in the same abode.

    Ah, the Austin real estate game. One of the only things I don't miss about living there. Do you live in the student neighborhood? UT has resources for students dealing with shady landlords. What proof does he have, aside from this thread, that there were more than 8 people in your place?

    i'm not a lawyer, but wouldn't he have to provide proof that there were more than 8 people at your apartment. Wouldn't he need pictures or names. Perhaps he counted some individuals twice. ;)

    I would imagine he'd have to provide proof, but you did breach your contract, right?
