A lot of my Christmas gifts I already know about...at least 90% - After seeing epic lines and such I kept telling the wife to maybe hurry up and get one particular gift that she pre-ordered. On 11/13 my wife finally got the COD XBOX360 320GB console out of reserve. She almost waited too long. At the store there seemed to be confusion, and a rush of shoppers..and to summarize the nuances, she got the last one they had - others were at the store hoping to get one but since my wife paid a reserve, she was granted the last one... Fast forward to yesterday,...the tree is up, the gifts are wrapped except the XBOX COD console ...so I said "hey hunny, since you got your Ipad2 as a gift and already are messing with it, I'm going to set up the XBOX and check out COD MW3" . . .. As I do, I am noticing there is NO game, ..."well they gave me a code (on the receipt) that I also bought a year subscription to XBOX live, maybe you have to download the game" - my wife said... well, got it going - connect to the home wireless,...picture looks outstanding with the HDMI and the larger HD T.V. (compared to the Wii we had already set up in the bedroom) ... But yea, nothing there...reality soon sets in ...No freaking game. I check the box, recheck, look around- all that...nothing So I call the store (here is how it goes) me: Hi could I speak to the manager if he is available employee: I am the MOD, what can I help you with? me: (my story) employee: So did you buy it at this store?, we have been out of that for awhile. me: yes, the receipt has your store info. on the top. My wife apparently bought the last one. employee: well,... I don't know what to tell you. Microsoft seal the packages, and we are not going to give you a game for free. me: (not happy with exchange ) I don't want anything for free, I want what I paid for, plus this "I don't know what to tell you" is unacceptable. employee: you don't have to be that way, if you want you can talk to the store manager - he comes in two hours me: look, you'd be unhappy about the situation if you were missing a game, how about you give me corporate's number then? employee: sure, but there is no need to be that way and get upset, I'll get it for you... Obviously, the kid was no real MOD, just an employee and I calmed down realizing such considering his "no idea type" responses I have spoke to corporate and a District Mgr. is suppose to call me in 3 days...Truthfully, worse case scenario is I am SOL and have to spend $60 on a new COD MW3 game ...worse things can happen...I just wanted to share so other people may beware ...
A buddy here at work also had a similar story, but in his situation, it was at FRY's (I don't know what your store was), and it was for the bundle that had a PS3, a movie, and a game, but you just had to ask an associate for the game and movie, since they weren't in the package. EDIT: darn it, your thread title says "GAMESTOP." FAIL. He bought it, took it home, and that was a couple weeks ago. Jump to day, and he thought the game was supposed to be inside the box, and it wasn't. He called and they pulled up the ad and since it had been a while back, they no longer had the game or the same price for the same PS3. He also admitted that he knew he had to ask the associate, but didn't, so he thought that maybe the FRY's peeps would be cool, but NO. To make a long story short, they couldn't honor it and he returned it and got a higher-end PS3 with a movie and a free game, so he is essentially getting the game for free, just like with the first bundle, but now is a large PS3 hard drive. My point is... you might be out of luck, because it's too late. I am not defending the store, but you should have checked the box contents listed on the outside (usually tells you "with a game inside" or it doesn't).
Gamestop blows. They have the worst refund policy. Admittedly everyone tries to screw them over since they are in the used business, but they are never cool about things. Most recent purchase, I was given a 3 day return period. 3 days? It used to be a week. You can't buy Christmas gifts from them, because they can't be exchanged. I hope you get your game, but I wouldn't count on it.
If you call corporate and complain about your experience they'll probably give you a $20 gift certificate for your troubles and dealing with that employee, that's what they did for me.
It seemed to be, but I didn't inspect the seal carefully. It definitely is suppose to include the Call of Duty MW3 game though... The console is cool with it and the wireless controllers being decorated in "COD MW3" silver and black graphics but... no game.. .sigh ..I was so pumped to play it as well . . . I'll keep yall informed of the latest . ... I did tell my wife worse case scenario is we may have to eat the $60 game that we should have received (worse things happen to people you know) but she seemed more upset about...
Damnit now I am scared man. I got my wife an early Hanukkah gift so I am expecting my gift early as well which is the same Xbox. I might say open it at the store.... Only thing different is were getting it at Walmart (using my discount)
Gamestop's been doing this for years. They're well known for opening game cases and selling them as new. It sucks, but now you know never to buy a new game from Gamestop again.
I don't know what Gamestop you went to, but they didn't know what they were talking about. Seven day return policy is printed on the receipt. Also, anything bought between now and Christmas can be returned with a receipt until January 15.

Gamestop does blow. I remember calling in one time to see if they would do a price match and the dude on the line told me to hold a minute and he'll ask his manager. He never came back to answer... Also remember buying a preowned game there before and bringing it home to find out it doesn't work cause it has a billion scratches on it. The people they hire are mostly idiot d*ckholes and they always screw you over on trade ins.
The game was supposed to come in the box, they can't just hand you a game because it's not their fault, it's the factory where the X-Box came from. You should have called Microsoft customer service, at most, Gamestop should take the bundle back and refund your money, it's basically a "defective" item and they don't have another one to replace it with.

I bought a 2 used games, a used harddrive, and a transfer cable. I've bought brand new, sealed merchandise before, and something from inside it ends up not working or missing. Gamestop doesn't take those back. Case in point is this thread. Now, within 7 days, I've never had a problem returning defective used merchandise, but only for the exact same thing.
How do you know Gamestop didn't take it out? They do that crap. Though calling Microsoft has a better chance of working out positively.
Okay phone call received at 5:58pm today ...Gotta give credit where credit is due... For some reason, I am anticipating a phone call (if I do receive a call) from a male District Manager with a know-it-all personality telling me Gamestop cannot control such issues of packaged consoles and telling me I could get a partial credit at the most... Instead, it is a VERY pleasant (and fairly young-sounding) female voice letting me know she wants to resolve this issue. I explain everything and she listens, does NOT interrupt and tells me afterward that her husband can't wait for Christmas either,...and yes, "just see the store manager - he is fully aware of this issue and will have the game waiting for me" ... ... - I then thank her very much and I will be picking up a fresh game at noon Saturday . . . I understand (like Oski2005 pointed out) Gamestop could have absolved themselves of any fault or blame, but they did the right thing. The District Manager showed the right leadership...taking care of customer problems is often times a lost art.
