So, if they declared the lockout over, all the contracts are void?

Are they void now? What would stop a renegade team from just tossing the finger at Stern and signing players?

Remember when the XFL had a TV deal? You think FOX, for example, would forego a good money making opportunity now because this might somehow lower their chances on getting in on an NBA deal in 6 years?

You think the NBA would not take the highest offer in 6 years and screw themselves out of money because of something that happens in 2011?

They can do whatever they want with players, including appointing a number of "captains" and pick guys playground style. They can also keep current teammates together and go forward on that basis. If they can sell tickets and TV rights, they'll figure something out.

I think (again, just my best guess) that the owners COULD once again unilaterally enforce existing contracts IF they opened their doors under the prior CBA rules.

If so, and if the players ever managed--against all odds--to get their own new league off the ground, I could see Stern and the other owners doing this (even if it means one more year of several teams suffering operating losses) just to scuttle any chance of the NBA having a serious competitor.

Again, highly unlikely. But I am shocked by far fewer things than I was even a few months ago.

Thank once again man. I have a much clearer understanding now. Nice easy summary.

I just hope the process moves along quick. I dont want to see weeks go by for each and every step/process.

NBA owners had 20-minute conference call today in which David Stern updated them on labor situation. No strategy was discussed, source said.

    Chris_Broussard Chris Broussard
No further meetings or conf calls among owners or between league and players are currently scheduled.

One ownership source doubts there's a season: "There's just not enough time. I imagine another effort will be made toward end of December."

If they don't discuss strategy then how does the call even last 20 minutes? As an "update"? "Players have disclaimed & filed suit. Bye."

In letter from NBPA obtained by SI.com, they inform players that "guarantee shortfall payment" checks worth $58K are ready for distribution.

    sam_amick Sam Amick
Money paid out b/c NBA fell short of hitting 57% of BRI last season & is paid 2 players who were on roster 4 at least half of last season.

    sam_amick Sam Amick
Players who played less than half the season on a roster get a pro-rated amount. Sock that money away gents. You're gonna need it.

    sam_amick Sam Amick
Letter was from Nov. 15. Not sure if it was out yet. Apologies if it was.

    sam_amick Sam Amick
For this stated purpose, yes RT @RimeOrReason @sam_amick So it's just one check?

    JonesOnTheNBA Nate Jones by sam_amick@
@sam_amick this doesn't include the escrow $ returned to players earlier this off-season or the group licensing $ from last yr either

Someone making around $5 Million has seen around $500k (escrow + BRI shortfall + group licensing money)

Chris Broussard thinks there will be no 2011-2012 season and the players and owners will renegotiate around spring time to have the 2012-2013 season to start on time.

    A. Stephen Smith believes an "inside source" told him thinks there will be a deal reached by/in 2 weeks.

Skip Baseless thinks the players will cave around Christmas when the season unofficially begins.

Players often talk about partnership w/NBA. Ex-union chief Grantham tells USA Today: "They're employees. They're not partners."

AWESOME. This is what I have been trying to tell people, lol... However, the point of the CBA is to make a fair deal between the players and the owners; so it does give them some say-so:(.

Stephen A Smith says, based on what he has been told, that he believes the NBA will have a deal within two weeks.

Let's keep this simple. FIBA actually has control over what league the players are allowed to play in, not NBA owners. If the NBA and players can't come to agreement, I'm willing to bet FIBA will not force Deron Williams to stop playing in Europe just because the NBA says so "unilaterally." Another scenario, let's say Pau Gasol says "screw this, I'm going back to play for Barcelona." Do you think FIBA will make him come back just because the NBA owners made a unilateral decision to tell him to come back?

So, if FIBA won't make Euroleague players come back, then the same would likely be true for a new league.

As for the CBA, it has expired. The league had an option to extend it by one year, but let the option expire. There is no agreement. (My best guess is) Now that the CBA has expired, you cannot create and/or force any new CBA on the players without their signature.

Now I suppose if the owners end the lockout (or the players win in court to end it), then the players will have the option to accept the terms of their current contracts and start playing again. But, (and this is my best guess), there would be no legal grounds to force Deron Williams to come back...no player would have to accept the terms of their Uniform Player Contracts that has no CBA. There would be no legal grounds to prevent them from playing in any league they want. FIBA could easily override the NBA and say the players are allowed to play in any league. I mean, how would trades work, if the lockout ends and the players refuse to accept a new CBA.

I have a scenario where a new league succeeds. At some point, if the owners keep refusing to allow games (like a year from now), the big market owners could (just a guess) sue the league for lack of performance under their franchising agreements. Just seems at some point the owners would have a right to rebel based on their franchising contracts being worthless.

So, 8 NBA teams bolt by forfeiting their franchising licenses to form a competing league. They would immediately get TV contracts for fielding their current rosters, to fund their operations. That would destroy the league. And since many cities own the stadiums, the NBA could not prevent use of the stadiums.

I think the biggest problem a new league would have is finding places to play. I don't think they can just go into the current arenas and play.

why? The NBA does not own the stadiums; most of them are owned by cities or owners. See my scenario above, in my previous post. If 8 big market owners bolt from the league based on their franchise licenses becoming worthless (for lack of games), then that's it...end of the NBA.

Couldn't they just buy out an existing league like the CBA or NBA that has everything in place and change venues to better arenas? If Isiah can buy a league, I am sure the NBPA can afford one of them cheap leagues.
