    The majority of players didnt agree with Hunter, just the player reps who probably weren't fully informed either

    That's what bugs me about this... the actual full union was never given a vote or a chance to see if they would be okay with the deal. They can mail them decert letters but not the proposal?

    As far as the Union or whatever they are now, They are hoping that the owners will come to the table again with a better offer and that wont happen. The owners dont want to deal with Kessler and would rather let the union file suit and file a motion to dismiss.

    That means 60 days. That also means that the earliest both sides will negotiate will probably be mid January.


    As far as hardliners, it doesn't matter if they didnt want this deal because they were outnumbered. All the NBA needed was a majority vote and Stern had that, so there was a deal to be made

    Truth of the matter is Jeffrey Kessler stands to make a bunch of money off of this move, so im most certain he pushed for this

    Billy Hunter wants to keep his job one way or the other, matter of fact if it goes to court he said he would be one of the trial lawyer$$$$... remember Battier asked him if he'd relinquish his paychecks like the NFL PA president did and he didnt get an answer?

    These guys have full all out agendas.

    And so it begins:

    This comes as no surprise based on what we've already reported. Players' attorney David Boies told reporters the suit will challenge the lockout as an "illegal boycott." The players signed as plaintiffs in the case will be Carmelo Anthony, Chauncey Billups, Kevin Durant, Leon Powe, and Kawai Leonard. Boies joked the case will be filed in Northern California due to a "fondness for Oakland" from Billy Hunter, then followed by saying it was because it's expected to help with expediency, and in reality, because the district is known to be union-favorable. You can expect the league to file to move the case to the 2nd circuit in New York, where they filed their original suit against the players pre-emptively.

    Boies also told reporters that they would not be asking for an injunction, but a summary judgement instead. Boies said the collective bargaining process "absolutely had ended" which is more coverage against the league's assertion that the disclaimer of interest filed by the NBPA is a "sham" used as a tactic in negotiations. The players are asking for treble damages, which would mean triple the amount of whatever monetary amount the players ascertain they are owed due to the lockout.

    Boies said it is possible to get a summary judgment before the cancelation of the season, but also said that the goal is to resolve it out of court. Which you have to wonder how that's going to affect the sham argument.

    Two to three other players filed suit in Minnesota, the same district that the NFL case was fought in, according to Boies, with more possible. It's a barrage of lawsuits, essentially. Boies said that the California suit will include David Stern's ultimatum regarding a reversion to a more conservative offer from the league if the 50/50 proposal was rejected. Boies said "That's not collective bargaining."

    These dummies need to look at what happened in to the NHL. In a bad economy players always lose.

    Ian Fitzsimons from 103.3 ESPN radio in Dallas reported that it was not a unanimous vote but more like 60/40 and every time one of the players wanted to settle the meeting down and go over the proposal Billy Hunter would sidetrack the effort by telling everyone that the owners were just trying to screw the players. He said the proposal was never fully explained to the players in the meeting. Essentially Hunter did not want the proposal to go to a vote because he was worried it would pass.

    Sorry no link because it was reported on the radio earlier. Sounds to me like this has become personal between Hunter and Stern.

    Some highlights-

    -The latest proposal had over 30 B level issues regarding contraction, drug testing, etc. that were hidden in the deal. The powerpoint presentation that was made public left out over 30 issues that the players would not have had any say so against.


    -Collusion- Which in this case is illegal. There is good indication that the NBA made backdoor agreements with new owners that bought teams like Golden State to get them to help sweeten the pot in buying NBA franchises. Basically the agreement would be something like if you are to buy the franchise at this price then we will guarentee you in the next CBA that THIS or THAT will happen.

    Of course Im sure there is most likely no evidence that this happened, but expect this to get brought up in court coming soon to the State of California.

    -Players could sue the Union and Hunter for damages and loss of pay due to mishandling of negotiations.

    It is tension-filled moments like the one reported by Yahoo! Sports on Wednesday that Hunter is trying to avoid.

    According to the story, agent Bill Duffy was reportedly questioning the union's strategy -- or perceived lack thereof -- during an August meeting in Los Angeles when vice president/free agent guard Maurice Evans interrupted and cursed at Duffy while defending Hunter. It's a role Evans has grown accustomed to, as he did a similar deed in late June when free agent forward Shane Battier suggested during a union meeting that Hunter follow the lead of NFLPA head DeMaurice Smith and forgo his salary during the lockout.
