    David Stern is going to EXPLODE! I bet the season is cancelled by the end of November. Farewell NBA season.

    As you can see, this meeting is pretty heavily attended. . . .We are here to announce we arrived that the CBA process has broken down. We served notice of disclaimer on Stern and the NBA. Players not prepared to accept any ultimatums. We have negotiated in good faith for 2 years. Players felt they given enough, the NBA was not willing or prepared to negotiate and things werent going to get better. Prepared to file this anti-trust against the NBA.

    Derek: As Billy said, we as a group of players, after 2 years of effort to try and close a CBA, we've come to the conclusion that that has not worked for us. As a group, unanimous fashion, every player rep, we decided this is the best decision for the players. A lot of player individual players have things at stake but we all feel its important for our entire group that we not only try to get a deal done for today but the players entering the next decade and beyond. We will allow our legal team to lead the charge and at some point assist us in getting a deal done fair to our entire body. We chose this today but we did not choose to be in this position. This is not a strike. We want to go to work and want a fair deal. We cant continue today. We will disclaim as a union. Thank you all for being here day in, day out. This is important to our palyers but this is where it stops.

    Hope a lot of players lose there career. Season is over. You chose not to allow your members to vote therefore you put yourself in this position.

    They should have at least let the players freaking vote. This is ridiculous.

    Hunter: As you can see this meeeting is well attended, reps from all teams - well represented.

    We have arrived at the conclusion that the CBA has broken down, and we plan to file a disclaimer filed.

    The players are not willing to accept the ultimatum, it is not fair that they would have accept a proposal or roll back, we have negotiated in good faith for 2 years, particularly if you look at the give backs and concessions, they have given enough, the NBA has not negoitated in good faith, announce to you that what we have done is combine lawyers and are prepared to file anti trust against the NBA, it is the best situation in which the players will get due process.

    We will be converting players association to a trade association and allow players to file lawsuit against NBA.

    Fisher: After 2 years of effort, we have come to the conclusion that the process has not worked for us to negotiate a fair deal. As a group in unanomous fashion, all reps plus alternate reps, have decided this is the best deal for the players. A lot of individual players have a lot at stake in their own careers but we feel it is important that we not only try to get a deal done for today but for all players coming into the league in the next 10 years.

    We are going to allow the legal team to move forward to get us a deal that is fair to our entire body, make it clear to the fans that we have not chosen to be here, but the lockout has been impossed on us, it is not a strike, we want to negotiate a fair deal and get to work, but we can't continue today, and effectively going forward we are letting our legal team lead us from today.

    It is important for our players and this is where it stops today as a union.

    Press; How would a disclaimer work?

    Hunter; Once we disclaim, we will file a suit within the next 2 days after decertification. If we were to decertify, it would take 45 days, but we have closed that loop hole by filing the disclaimer.

    Our lawyers will have to resolve, it is now more like a settlement, rather than a negotiated bargain, the NBA could open up its doors and have a season, we feel we are in pretty good shape, the NBA has filed a suit to forum shop, as they felt they had a better chance if it was here in NY rather than another court room, the players are willing to live with that.

    We just let the NBA known in the last hour when we served the disclaimer to Commish stern's office.

    Reporter: What were the issues?

    Hunter 6 issues, that we sent back before - trying to fix the system, the NBA offer was regressive in some regards, it was a system in which we felt we could not fucntion, for the most part a hard cap, extreme tax and not something that we could function.

    Fisher: Real quick, now that it is a legal matter, just want the players to know that it is extremely sensitive to our players - some will be declining comment going forward, please forward those requests to our office and respect that this is a legal matter now.

    Hunter: Issues were the 6 issues we identified before. Some concessions on the system and we were unable to deliver any of them. The NBA proposal was regressive. It went back as opposed to open or flexible. We had a hard cap, extreme tax, reduce the length of contracts, all the stuff you guys been writing about.

    Fisher: We want to make it clear for our players, now that this is a legal matter, we understand you have jobs to do, but this is sensitive for our players. We'd appreciate respect that this is a legal matter. Players will be declining comment going forward. We'd appreciate you respecting the process and not putting them in a position where they hurt the players as a whole.

    No. What would have been courageous is allowing a vote. If it was voted down and THEN they took this step, I would respect it.
