A police spokesman confirmed Buford was arrested after crashing into the fence in the 500 block of N. Leona just west of downtown late Friday night. The police department said an officer from the Bexar County Hospital District first responded to the scene. SAPD then arrested Buford. Records at the magistrate's office show Buford was charged with driving while intoxicated with an open container. He posted bond and was released early Saturday.[/rQUOTEr]

I've never really understood the point of arresting ppl for drink driving, cite them (loss of license, large fine, yadda), let them get someone not intoxicated to drive the car and if no one impound it. Waste of jail space and time really, it's an act of stupidity not of criminality.
People who drunk drive should be heavily fined or sentenced to prison. He could easily have ran over someone.

No, it's an act of stupidity AND criminality, and the punishment for drunk driving should much harsher than it usually is.
You are extremely ignorant. Removing a drunk driver from the road is a "waste of time". Earlier this year i lost a very good friend to some idiot who was drinking and driving. Should the police have driven the drunk driver home to save jail space? I've been on this site for ten years and read many ignorant posts, but i can sincerely say this is EASILY the dumbest thing i've ever seen. I don't know how many loved ones you have, or if you're just 12 years old and haven't lost anyone yet, but before you die, i can almost guarantee a drunk driver will kill or hospitalize someone you know.

I know what Aleron is getting at. There are all sorts of acts of poor judgment that we don't punish unless the potential consequences are actually born out. But if you are going to fine people for speeding because it's potentially dangerous, it makes sense to enforce a harsher penalty for DUI since that is potentially more dangerous.
All I'm saying is there is no point in arresting someone for a misdemeanour offense, I think it's a waste of time and resources (they end up using a bunch of resources for nothing, to detain, book, etc), obviously if it's more than just drink driving, it becomes a felony, which is a completely different story. I never said lessen the penalty, the punishment thereafter is a different issue altogether, I'm talking about the process upon discovering a dwi. Does arresting him overnight and releasing him in the morning differentiate potential risk whatsoever on any outcome that simply making sure he was removed from the road wouldn't achieve? It would however allow police officers to return to duty to do other things in a shorter time frame. They have better things to do than continue to bother dealing with some stupid drunk after he's been removed from the road.
You're contradicting yourself. You are asking to lessen the penalty if you don't want him fined and arrested. And DWI is a serious enough concern to warrant such punishments.
