Btw, this is only for the accidental damage. They can be punished for the intentional damage.

I guess we'll have to agree to disagree here. I understand where you're coming from, I just don't see it working out that way.

I can't say for sure, either. It's possible the damage was intentional but, as is, there's not enough evidence. Defense lawyers would make this part of their interview.

Without actually looking up the definitions, one can be charged with assault without actually having caused physical harm. Battery is when physical harm has occurred. IOW, one can absolutely be charged with assault without being also charged with battery and vice versa.

If someone threatens me with a baseball bat, but doesn't actually cause me harm, that is assault. If someone threatens me with a baseball bat and hits me, causing him, that is assault and battery.

not true. and some states classify it all under 'assault' - not sure if that is the case in texas, but seeing as how the bodyguards & hairdresser physically attacked him and the only charges filed were 'assault' that is probably the case.

i linked to the article simply to show that they were already charged w/ assault, which you seemed unaware of.

not to be rude, but most of what you have stated over the last couple days has just been flat out wrong.

EDIT: i did find some texas related info on assault and battery. there is absolutely nothing to back up your claim that "intent" or "intended level of damage" plays a role in anything. the key factor is level of harm/injuries inflicted - again, there is nothing about "intent".

Do you really have any real expertise in this area(ie criminal lawyer) or are you just an internet expert?

Nope. I'm not gonna cover for your half-assed internet research. You go read a book.

I have taken some law subjects, have friends who are criminal and civil lawyers and am considering on getting a law degree in the future.

You've been quite wrong in your assertions regarding this case -- seems IMO that you need to offer a bit more than: I have taken some law subjects, have friends who are criminal and civil lawyers...

Please name 3 law classes you've completed.

I don't need to offer anything especially to someone who's trying to poison my well. I am not giving professional opinion here. The concepts I am talking about are familiar to anybody who has taken some law and, I think, are relatively accessible even to average people. I would appreciate it if, if you actually have any idea of these concepts, to discuss this properly and civilly. What I don't appreciate is somebody telling me I'm wrong with nothing to make an argument, who probably has no idea what he's talking about, and is questioning my credentials.

so in other words, you have been talking out of your ass. and for the record, i am actually reading two books right now!

    nope.

i actually provided not one, but two links proving that you are wrong. you, on the other hand, have provided nothing to back up your assertions.

    what "credentials"?
