How can you have an understanding of a suit that hasn't even been filed? It really doesn't matter when the interference occurred as long as it was the proximate cause of the breach. Even if both parties absolutely intended to carry out the contract when it was signed, there can still be tortious interference as long as there was a breach of contract with the aforementioned requirements. Also, even if UT breached their contract with the Big 12, that is NOT a legal justification for A&M or any other party, other than the Big 12 itself, to do the same.
By your definition, no team could ever leave because the conference always has some sort of contract in place. Tier 1 and 3 contracts are not aligned. You are right though .. Im sure the SEC and A&M never even consulted a lawyer on this and they are both willing to leave themselves open to a huge lawsuit. Texas sure does seem to need A&M for a school that likes to claim they dont care about us.

All the talk about a lawsuit is pretty silly. Regardless of the merits, the Big12 is not going to sue the SEC and drag the various TV networks into any of this - because all those parties need to maintain strong relationships going forward. And the Big12 isn't going to try to keep A&M in the conference against it's will through the threat of force. No one wins when you have a pissed off member of your conference that wants out and is being forced to stay - it's like having a coach on your team that doesn't want to be there, despite them being under contract. It's just not a practical endgame for any of the parties. The threat might work, but if the SEC/A&M calls the bluff, there won't be any kind of lawsuit coming out of this.

Big 12 is a very top heavy conference. But I think its equally "disrespectful" and a "slap in the face" to all the other 8 schools besides Texas to think they're just pawns in Texas's big chess game and that they themselves aren't getting affected somehow. I think the conference AS A WHOLE is NOT comfortable having ANY kind of conference instability and insecurity. Also, my personal thought, how is having 3 different bosses to contend with in the SEC any more beneficial than one major boss in the Big 12?
The only people who know all the facts are the decision makers at A&M and the SEC. If they are sane, competent, fit for duty AND seal the deal, the lawsuit talk is bluff and bluster.

A&M hasn't been in the top ten in recruiting even with their uptick and in the 90's, they almost had the death penalty in 1994. They have always been behind Texas and OU. They essentially get the kids from the "aggie" towns and the kids they pay.
This is right on. It's crazy how much sh** TAMU talks after ONE 9-4 season. They haven't been a top 10 in recruiting for so long. They are really irrelevant in football. The problem is if you have 1 aggie thinking TAMU is amazing, you have 50k aggies to back up any thought, no matter how absurd it is. They will get killed in the SEC and learn. I don't have a prob with A&M saying their good, but for whatever reason they think they are consistently better than UT, which is just annoying. They are considered UT's annoying little brother because they draw that upon themselves, especially with the childish "TU" insults. Be consistently better than UT, then talk, and people will respect that much much more.
You don't have to have top ten recruiting classes to compete for national titles. Auburn and Oregon proved that last year. You just have to recruit well and get a few impact players.

For as much as UT fans say they don't care about A&M, this thread suggests the exact opposite - the obsession pretty clearly runs both ways. There isn't an Aggie fan in this thread talking about comparing themselves with UT - it's only the Longhorn fans that are obsessed with that topic. I can't figure why our fans care so much what A&M does. Let them go on their merry way. If we really don't care, it doesn't affect us while they'll be happy. Everyone wins.
I'm off living in the West Coast. I had family members in A & M, friends in UT. I have affinity for both places. I don't care about any hostilities or rivalries. I don't know where it should matter what Texas thinks about A & M going to greener pastures. Its a whole lot more complicated than a school just needing a "whooping boy" to keep around. Yeah I think "Texas needs A & M" is a bit much to say. Texas DOES need A & M, to conduct itself as a stable CONFERENCE MEMBER. It does NOT need A & M to "survive".
Very well said ... I don't know of any Aggies that think we are in a better position than Texas. We are trying to get ourselves in a better position.
Let's look at the recruiting rankings for A&M based on Rivals going back to 2002 (the latest I can find) 2002 - 23rd 2003 - 10th 2004 - 13th 2005 - 8th 2006 - 26th 2007 - 43rd 2008 - 16th 2009 - 22nd 2010 - 17th 2011 - 27th 2012 (so far) - 11th Are those Texas recruiting number? No, but there are not many that can say that. Those are VERY respectable recruiting rankings. The problem was not getting talent, it was doing anything with it under Coach Fran. We lost a decade because of him and Mike Sherman is getting this thing turned around. The 2012 class looks to move up further from where it is, and we already have signed the best QB and WR in the state for 2013. Recruiting is looking even better and would get even better if we go to the SEC. We may never be Texas/Fla/Alabama (and I've never heard any Ag claim that), but to say that we will always be down is ludacris. At some point this team will win and win big, and it will be even sweeter in the SEC if they can make it there.
I should clarify as that was not really what I was trying to say. Texas can certainly live without A&M, but as hard as they are trying to force A&M to stay, they are acting like they can't live without A&M (which is contrary to the Texas manifesto that they don't care about A&M). Obviously both schools will be just fine without each other.
