    Yes, I would say so because if later she decides to sue, she can say that she said "no" and resisted.

    But that shouldn't stop you.

    No but haven't you guys ever wondered about it? I took my only law class about a year ago and was about to ask it in class but thought it would be inappropriate to ask a criminal law question in a contracts and obligations class.

    I would certainly think it is still rape; the girl might just be pretending to enjoy it so you will let her go when you're finished, or will not harm her further. (scary to think of but sometimes it crosses our minds what we might do to survive if we got in that situation)

    To answer the question, it is rape, since it is rape initially. Whether the girl changes her mind later is irrelevant to that.
