Pedestrian convicted of vehicular homicide in own child's death

    I'm . . . .. confused and require more explanation.

    The driver - Had been drinking and has previous conviction for hit and run

    But the mother is convicted and sentenced to a longer time

    Sounds pretty crazy. I am just guessing though that the alcohol was found to have no effect. Also don't know what the logistics were. Maybe someone who has been to that location can comment on how crazy or reckless the crossing was. I do wince every time I see families jay walking in less than ideal circumstances.

    Looks like the more severe charges against him were dropped. I guess they didn't feel they had enough evidence, but they did against the Mom.

    Looks like Austell Rd. is an uncontrolled street and Austell Circle enters from only one side. This would not be a safe place to cross. It looks to be about three tenths of a mile to the nearest crosswalk.

    It is incredibly reckless for a mother to lead her children across a street like that. Punishment is warranted.

    She hasn't been sentenced yet. I'd be surprised if she was sentenced to the full 36 months. Although what she did seems dangerous and reckless, I suspect she has been punished enough and will continue to be for the rest of her life.

    From the information provided it seems like she might've been reckless with her kids but vehicular homicide to me makes no sense. It seems like reckless endangerment would be the more fitting charge.

    What part of "up to 36 months" do people not understand? That's the sentencing range. But I didn't see anything saying she couldn't get probation, if the court deemed it appropriate.

    What was the pedestrian's criminal history? Was she also intoxicated? The article leaves more questions than answers.

    The story you quoted did not say she was sentenced at all. The suspects that usually get the maximum sentence are repeat offenders.

    Speaking as someone who rode Metro all through college and had a single Mom who worked odd hours all through high school, I really don't understand why there aren't more sidewalks. I might also inquire as to why someone with three kids doesn't have a car or some kind of access to reliable, safe transportation.

    Sentencing was today. As suspected, she did not get sentenced to 3 years of jail. She got 40 hours of community service and she is on probation for 12 months. I suspect the only reason this was news was her color.

    The driver served a six month jail sentence, while the mother ended up getting probation. So the driver did end up getting a more severe punishment.

    Two people made mistakes that resulted in a child's death. Both people responsible for the death were charged, convicted, and punished.

    Ridiculous. I wonder what good the local authorities think they'll be doing bringing charges against a mother of three that could take her away from her two living children for three years. If she had money, I doubt she'd have been walking across that unsafe road to begin with. How can you commit vehicular homicide without driving a car? If I were a lawyer, I'd defend her free of charge, and then file a civil suit against the local authorities for negligence in not having a safe crossing point at that intersection. The local authorities should be ashamed of themselves.
