Men don't know what its like to carry a fetus. Or have a uterus. Or have a vagina. Or child bearing hips. Or give birth. Or have breasts. The you-don't-know-what-its-like "special condition" can stretch into anything.

So does that mean she should only be tried by females who DO know? And men should just keep to themselves?

Can't overlook the fact that females don't know what its like to have biological male penile impulses TO impregnate, but women have NO PROBLEM being regulatory toward male elements. "My Body - My Choice" can be odd like that.

I do agree empathy should be practiced. But i don't think empathy should lead to a full on EXCEPTION from judgement.

 

According to the article she did intend to kill the fetus along with herself.

If she was trying to kill herself, then by extension she would have to terminate her pregnancy.

The fact is that a fetus both counts and does not count as a person in the eyes of the courts depending on circumstances. In this case, it does not make sense for her fetus to count as a person because she was trying to harm herself. She should social and psychiatric care, not jail time.

Then again, I am not from Indiana and have no idea how their interpretation of the law works.

I don't have all the answers, Shroopy. But what I do know is your bitterness towards women shouldn't shroud your judgment. As long as people of both genders understand the amount of emotional distress someone in her position could be in, I'll be fine with whatever the jury is made up of. It might not be insanity, but it's hard to have lucid thoughts as a woman in certain situations.

Emotional distress isn't a kill your baby and suffer no repercussions card. She was at 33 weeks :



It's not considered unusual for a baby to be born at 33 weeks.

She was lucid enough to understand that she was killing her baby. That's murder.
