Reverse discrimination, addressing a historical wrong or not compelling enough for courts to care?

Gay league can limit straight players

A gay softball association in the US can limit the number of heterosexual players on its teams, a federal judge ruled Thursday.

The decision to allow the North American Gay Amateur Athletic Association (NAGAAA) to enforce a rule of two "straight" players came in a lawsuit filed by three bisexual men who claim they were kicked out of the Gay Softball World Series because they "weren't gay enough," the Courthouse News Service reported.

US District Judge John Coughenour wrote in his ruling, "Plaintiffs have failed to argue that there is a compelling state interest in allowing heterosexuals to play gay softball."

"NAGAAA might very well believe that given the history of gay exclusion for sports, the only way to promote competition for all persons, and ensure that gay athletes have the same opportunities as straight athletes, is to create an exclusively gay community with exceptions for a small number of straight players," the ruling states. "It is not the role of the courts to scrutinize the content of an organization's chosen expression."

However, Coughenour said the lawsuit could proceed to trial because questions remained about the way the softball association applied its rule.

The suit was sparked when three men playing for a San Francisco-based team in the Gay Softball World Series in Washington state in 2008 were challenged about their sexuality by a rival team.

According to their complaint, the trio were summoned to a hearing room and quizzed about their sexual interests or attractions in front of around 25 people.

The men said organizers told them, "This is the Gay World Series, not the Bisexual World Series."

You treat people like they're different from you and that you can merely just "tolerate" them, well, they'll start acting like that to you too.

It just seems like we're doing Opposite Days just for spite now.

Like anything existing thats conventional, we're doing gonna do the inverse of it just to "cover all ground" for things to advocate.

I think someone's sexual orientation isnt as easy to validate as physical things like skin color, gender and ethnicity. So they can allow some "wiggle room" for players who are still on the fence or even who are not gay.

Though who are these SERIOUSLY straight grown men softball players who will join up in the gay league? Whats the benefit in even being the one token straight player? Either gotta be secure in your manhood to do that (as in you gotta gay brother so you're "cool" with the whole thing), gotta be REALLY deprived of organized softball league opportunities, or just by joining you've willingly crossed a line and you are to be considered gay or bi by default ANYWAY. Cuz its just 2 out of 15 or so players, you're not going to have "likeminded" peers?

Maybe in an individual sport like all gay tennis or all gay golf where there isnt any physical contact. All gay basketball, forget it. All gay touch football, soccer, not happening. Gay rugby, yeesh.

People can choose to associate (or not associate) with anybody they want in a voluntary manner. I'd be totally cool with a gay sports league making all heterosexuals ineligible to play. After all, it's their league.

    What up Nagaaa?

    Nagaaa please.

Nagaaa you need to get a job.

I find the abbreviation insulting and racist.

As for the subject at hand, unless we're talking about bowling or badminton, which is heavily populated by gay men and their quest for the shuttlecock, what kind of a straight man seeks out a gay sports league to play in? That's like playing basketball against a bunch of 5th graders so you can dominate. It's BLASPHEMY.

You can. Just like you can have a white only basketball league(no joke, google it).

The limit on straights reminds me of the CFL and Norwegian Bball league and their limit on Americans, in doing so they're reaffirming the perception of " This is our league for us."

Still, you won't be kicked out of those leagues for being "too gay", or in this case "too bisexual"

That might not be the case considering this is a gay basketball player.

This, just like straight people should be able to make a straight League, the KKK should be able to make an all White-Sheet wearer league, and any other group should be able to make up a league in any way they want as long as it is not funded in any way by the Government.

I don't think it's the best way to handle things.

On the other hand, how can anyone complain? After all the persecution and discrimination homosexuals have faced, we're now getting picky about joining their softball league?

It's like bullying a kid throughout highschool just because he's a nerd and then getting pissed off when he doesn't invite you to the nerds graduation party at his house.

When you take a look at the big picture, it seems like you can probably let go of things like this and hope that society reaches a place where homosexuals do not feel threatened by a lack of opportunities. It's important to note the reason for the restriction: to fight for a balance in opportunities and continue to provide a softball league free of discrimination against homosexuals.

This league is a temporary arrangement for people who are facing difficulties in other softball leagues. Once balance is restored, ideally this league loses its purpose, and there is no need for setting up separate leagues anymore. So while I think it's sad that the league thinks it needs to limit heterosexual participation to provide substantial relief from societal discrimination, this is probably not a big deal as long as people are constantly working towards solving the core problems that homosexuals face on a daily basis.
