HPD officer killed by illegal drunken motorist

    I think some just think the punishment should be harsher since he is an illegal.

    And it already is, he will be deported once his sentence is served.

    Question is - should it be even harsher? Or should he not be deported?

    I think Thad's comment was over the top.

    A discussion on harsher sentences for illegals can be a legitimate topic for discourse.

    But "harsher sentences for illegals" does not equal "I hate Mexicans".

    If it turns out that this guy has a prior and was not deported for some reason (anchor kid, sanctuary, etc.) - then the legality of his residence can matter.

    Of source there is a difference. Someone died in one case. No one died in the other case. That is actually a big difference.

    Someone driving home at 3 AM after having a few beers at (.9 blood alcohol), on a road with no traffic should not be equated with vehicular manslaughter.

    He should be tried for involuntary manslaughter. I think it's an equivalent to handling a lethal weapon without intent to kill. It should also be added to his DUI by a multiplicative sentence because he was breaking numerous laws at once.

    I think his legal status should be a part of the equation. He should be deported back to his own country to face trial there, but if he can't, there should be no reason he becomes a burden to our own. We aren't supposed to shelter the criminals of other countries.

    When you are as drunk and high as this guy was, you might as well be intentionally trying to kill someone. This guy didn't just go out have a couple of beers hit some jaywalker in the middle of the night and then blow a .08. This guy was flat out plastered and drove through a police road block.

    Fair point as well. But as long as you're not supporting the specious logic that this crime would not have been commited if all illegals were deported as Fox news is trying to paint.

    I'm not. There are two major wrongs in this case. The first one is he was intoxicated/high, drove a vehicle, and killed someone. The lesser one is he is an illegal immigrant. Those two independent things need to be fixed in this country. However, those two things are not independent when determining his punishment.

    Except that he broke US laws in the US so shouldn't it be the US's responsibility to punish him? I don't think we should expect Mexico or any other country want to deal with that when he didn't commit a crime in their country.

    Under that same reasoning do you feel that Italy should execute Amanda Knox, an American citizen convicted of murder in Italy, so Italians don't have to pay for her time in jail?

    This totally sucks but why does a death of a police make it any different than a death of normal citizen?

    First off, Italy does not allow capital punishment and therefore would not execute anyone. Secondly, Amanda Knox's situation is completely different. Despite the fact that she probably did it, there was evidence and some issues about the media and police investigating.

    In this case there is nothing that isn't fact. He was in fact, intoxicated. He was in fact driving the vehicle. He did in fact run it through a police barricade. He even drove a while, dragging the officers body. He had been deported two times before. Therefore, he deserves the maximum punishment. I would say the same for any citizen of America.

    I don't think the sentence for copslaughter is more than manslaughter.

    You skewed it by cutting out the rest of the paragraph. And if those are the only sentences you read out of that entire bit then that's not my fault. People are getting on to me about how I only think he deserves the death penalty because he's illegal, I was clarifying that any American citizen caught in that same situation would also deserve the maximum punishment.

    FYI, any US citizen will never be caught in exactly the same situation you just described (ie. deported)

    I am not aware if Texas executes people for vehicular manslaughter.

    Except in the Knox case that was done with premeditation whereas this guy didn't set out to kill the cop deliberately which under the law makes Knox's case more serious. Anyway the point I was responding to in your post wasn't that the law should apply any citizen of America but that since he is a foreigner we should execute him to save taxpayer money. IN that case then shouldn't other countries do the same to Americans so they save their taxpayer's money?
