Supreme Court: Cops can break-in to your house if they smell weed

    I haven't smoked weed in decades and have no plans on smoking it again but I don't like this ruling at all.

    This isn't about weed or other drugs but about the erosion of our due process rights.

    It's not a question of tough. It's a question of some one breaking into your home.

    I guess If I don't know who you are and you have no business being inside I have to ask you nicely what you're doing in my house?

    I've never advocated murdering innocent people but I do advocate self defense.

    The obvious problem here is the word "unreasonable" and while we like to think the constitution is perfect, this word has to be realized as being the flaw in this amendment. Whoever wrote it that way should have known better if their intent was as we ALL once saw it.


    SHALL NOT BE VIOLATED. The rest is about whether Warrants can and would be issued, not about finding ways to unreasonably search and seize without a warrant.

    The huge joke is that to fix the fact that they have tainted the fourth amendment while evidently pushing for this police state, it would take a constitutional amendment.


    To assume that any home that has a flushing toilet or a garbage disposal running or... god forbid... someone making any noise at all has conceded their right to the 4th amendment is a travesty and a shame that this court will bear... if the sheeple care enough to notice. Does that seem reasonable? I'm sure they think that circumstances might provide the reason, but of course that's not in the ruling, is it? No. Now it's just one more way they can do whatever they please, even though you're an American citizen... which once meant something in terms of freedom. Innocent until relentlessly probed beyond your paper rights to determine any kind of guilt, I guess.

    Exactly! If a person is compelled from fear by police entering without warrant, they'll be alot less cautious to let in uniformed "cops" or hell even fake "detective" figures acting on behalf of police departments. Just a ridiculous amount of citizen safety in their homes being overlooked.

    I hear what you are saying about defense. I also would like to protect my family and property, from both criminals and law enforcers alike.

    It's really easy to say online that "a cop breaking into my house is a dead cop." It's internet tough guy speak. Weak ****. Talking online about it doesn't protect anything. It's about how you want to be perceived. Whatever, that's your right. I hope that you are actually smarter than to shoot any cop illegally entering your home, and assuming so, that you are just blowing steam by saying such things.

    If you're serious though, and so confident in the juries and courts of Texas, then take your chances with the trial and let us know how it goes. I'm sure this thread will help you.

    I agree this just seems like a lot of internet tough guy talk.

    I don't like this ruling at all but I am not about to shoot it out with cops breaking into my house. First off I am more likely to end up on the losing end of that and secondly as you are noting juries and the public tend not to look favorably at cop killers.

    If the police burst down my door on the premise that I was destroying drugs I would much rather be a live victim of heavy handed police than either a dead victim of heavy handed police or a live cop killer.

    I have called my State rep 3 times so far this year. I sign petitions and join form letters. Maybe keeping it simple was wrong. "ANY intruder including law enforcement without just reason shall with my knowlege will not be welcomed".

    What a jacked up example of dismissing Ginsberg's concerns at the end of that article. That would already have fallen under reasonable search and seizure before ("He's going to kill me! He's got a gun" seems like it would fit under existing "Emergency Aid" exigency that is already considered valid), and really has nothing to do with explaining why she might be considered wrong or shortsighted in her concern for their ruling on the fourth amendment.

    Disingenuous article supporting conservative moves towards removal of freedom and inalienable rights through crappy example is disingenuous.
