So I just got this email regarding a class action lawsuit against EA Sports, specifically Madden NFL, NCAA, and Arena football games. Looks like they think it's a good time to go after NFL with all these problems already there. I'll be happy if I get my money back for the games I have gotten lol. Main complaint: The class action lawsuit alleges violations of California's antitrust and consumer protection laws in connection with the sale of certain football video games. Plaintiffs, purchasers of Electronic Arts' football video games, claim that Defendant Electronic Arts entered into a series of exclusive licenses with the National Football League (NFL), National Football League Players' Association (NFLPA), National Collegiate Athletics Association (NCAA), and Arena Football League (AFL), which Plaintiffs claim foreclosed competition in an alleged football video game market. Plaintiffs allege that this series of exclusive licenses caused customers who purchased certain football video games to be overcharged. Email I received.
I don't think they'll win. Exclusive licensing is not monopolizing, in my opinion. I'll wait to see what MadMax thinks about this... So how do you think you got the email message? Did you register your game with EA Sports?
Not sure how I got it. I haven't registered the game. The only things I would say I have done was play on Xbox Live back in the day and now on PS3 network. Maybe they got access to records of emails of anyone who has played the game online or something. That would be my guess.
How could anyone have been "overcharged" due to this? Are they saying because they were able to set their price that due to the exclusive licenses they were acting as a price fixing monopoly? I'm no lawyer, but that whole thing sounds pretty quid pro lame-o.
That would be the only thing that they can argue. That since no other company could make a NFL game with players etc, that they could charge whatever they wanted.
it doesn't have to be a "winner", very few civil cases go to trial, even fewer class actions go to trial. It just has to be a viable enough case to pass motion for summary judgment (which it probably is) and then they'll reach a settlement. I'm guessing everyone who opts in may get $1 - $2 back...no way would it be more than $10 (the lawyers on the other hand...).
Remember when ESPN Football was around $25 dollars? It was cheap, but It didn't quite feel like Madden. I felt the extra 15$ for Madden was always worth it. However, some games that are not licensed can still be fun. No Fifa game ever amounted to the fun I had with my fellow commies playing International Superstar Soccer on the N64. Where are they taking this to trial, judge judy? =)
So much fail in one post. ESPN NFL 2K5 was 20 dollars not 25. And it didn't "feel" like Madden? What is that supposed to mean? It was a different game made by a different company! And it was better than Madden by a longshot.
Got the email too. Their pricing was standard. Any new video game costs the same. They did charge for DLC though. When Sony lost something similar the people affected got about $25 I believe.
the gameplay just felt better on Madden for ME. The only thing I liked about the ESPN game was the Draft and the trophy/cribs. Haven't played a football game since 2006. My point is that when ESPN was cheaper, madden felt threatened. I (ME), not you, felt that it didn't matter paying the extra for Madden. I owned both, mostly played Madden.

So... did anyone else submit a claim? I've never been part of a class-action suit before... did it for the lulz and bc it only took 5 min. Filled out the form a few months ago and completely forgot about it until today. Looked up the status, and apparently they were about to pay out but some douche filed an objection and it's causing a hold-up. I mad. :grin:
