    LOTS of damning evidence came out today in the Comey case. This piece is particularly interesting, and it gives a window into how the dishonest FBI worked with the dishonest world of academia to leak information to the NYT. Multiple nodes of the Deep State exposed at the same time. Yet shockingly, there remain people who still think the NYT is objective journalism! They are (were) a tool of the intel agencies.

    US District Judge Cameron McGowan Currie in Alexandria, Virginia, said she would issue a ruling before the Thanksgiving holiday.

    “The only thing that matters is if Ms. Halligan had proper authority when she stood in front of the grand jury — and she did not,” Comey’s attorney Ephraim McDowell told the judge, who was presiding over the first hearing in the case.

    The government viewed the matter as “a paperwork error,”

    to Comey's defense for use in a potential future legal motion to have the charges dismissed.

    Comey is home free before he’s ever put on trial.

    Ty Cobb, former Trump WH lawyer, said Magistrate Judge Fitzpatrick’s opinion today will be taught
    in law schools for 50 years as the epitome of prosecutorial misconduct.”

    The former insurance lawyer, in her presentation to the grand jury, committed several acts of
    prosecution misconduct. it is grounds for disbarment. to the extent that Pam Bondi had ratified
    Halligan's presentation to the grand jury, the AG should also be disbarred.​

    This IS pretty extraordinary. I'm no lawyer, but even I know defendants always have the 5th right against self-incrimination, meaning they can refuse to testify at trial.

    The "burden shifting" here refers to the prosecutor telling jurors not to worry because Comey could "give his explanation" at trial. But that's backwards. It's a basic foundation of our constitutional law that the burden is on the gov to prove guilt, not on the defendant to prove innocence.

    And telling the grand jury not to worry about insufficient evidence now because better evidence would come later at trial? That completely undermines the grand jury's role as a check against unfounded prosecutions. Their whole job is to decide if there's enough evidence right now to justify charging someone with a crime.

    “Her time in the grand jury is extraordinary. She told the grand jury, basically, that Comey didn’t have a Fifth Amendment right at trial to refuse to testify. And therefore, he would be able to give his explanation as to the events and counter the government’s evidence, which the judge noted appropriately was burden shifting. And moreover, she told the grand jury in an extraordinary statement not to worry about the record with which they had been presented because the government had better evidence at trial. That’s like saying, ‘Please indict this person because we don’t have time to indict innocent people.’ It’s just way, way, way out of bounds.”

    Hold on... Are you seriously expecting me to believe someone from the Trump team doesn't actually know how to do their job? That's CRAZY! NO WAY!

    It's almost like they are put into a job position based on factors other than merit. But I was told that was purely for the realm of DEI hires. There's no way Trump would wesponize the justice department...

    I will never believe that even if he promised to do it

    The Justice Department on Wednesday admitted that the operative indictment against former FBI Director James Comey was never presented to the full grand jury — a procedural error defense attorneys say should bar the prosecution.

    The admission came under sharp questioning from U.S. District Judge Michael Nachmanoff, after several judges overseeing parts of the case had raised concerns about the government’s presentation and an apparent discrepancy in the grand jury record.

    Instead of presenting a new indictment to the full panel after it rejected one of the counts, interim U.S. Attorney Lindsey Halligan gave the grand jury’s foreperson an updated version — not seen by the other grand jurors — to sign.
