    14A didn’t stop private business discrimination. Supreme Court in Civil Rights Cases (1883) said it only applied to state action, not private actors. Which is why you only mention government discrimination.

    It also permitted government segregation. Plessy v. Ferguson (1896) upheld “separate but equal,” giving Jim Crow laws constitutional cover for decades.

    The CRA of 1964 closed those gaps by banning both state-sanctioned and private discrimination in public accommodations, employment, and more.

    So just to be clear- you don’t see Jim Crow laws as discriminatory? Correct me if I’m wrong.

    This is my experience with every current conservative person I talk to.

    They all claim they never supported Bush and thought he was sending us down the wrong road.

    I am old enough to remember the early 00s. You could not find a Republican to say a cross word about Bush and they all bent over backwards to cheerlead us into the middle eastern money pit... Not to mention castigate anyone who dared push back.

    How Republicans got such a get out of jail free card so soon after 10+ years of absolutely disastrous governing is beyond the pale.

    Where in the CRA was gay wedding cakes covered? We're talking racial discrimination - like having all white golf courses.

    If you are arguing that golf courses should be allowed to exclude black people, frankly, I find that disgusting. It's unbelievably that someone is making this argument on this discussion board. Ideology? It isn't ideology to say businesses should be color blind.

    To be clear — are you saying you find exclusion based on race to be disgusting, or the absence of state punishment for it to be disgusting? Because one need not lead to the other.

    There’s all sorts of actions most of us can agree are terrible that the government should stay out of. And when you allow the government to stop immoral/digusting acts (that fall outside their enumerated powers), that can be a slippery slope leading to state authoritarianism.

    I don’t agree with opposition to the Civil Rights act, but at least on principle of originalist/textual interpretation of the Constitution I can understand disagreement with it.

    You can't have a functioning society when race becomes a decider in how people are treated. Americas strength is equality and judging people by merit and character - move way from that, and you weaken our society.
