Whether it's technically illegal is subjective... definitions vary, and crossing the border isn't even a crime in all cases. What you're saying is like comparing it to speeding. Yes, speeding breaks the law, but no one would say it causes so much harm that it justifies tearing families apart. Separating families causes far more damage than the act of crossing a border. Legal or not, that kind of punishment isn't morally defensible. So yes... just like speeding.
