Usually one one makes a claim and someone needs to counter it, there are multiple layers of approach one can take with sometimes only one layer working. Like usually there is a layer that uses empathy to convince. There is a layer that addreses the legality, a layer that applies context etc. Your claim falls apart at all layers starting from the first basic layer of legality. There already are federal statutes in regards to material support for terrorism. That means a resident or citizen can be charged with this crime. So what charges does this guy have currently since he has already been arrested and detained. That part happens usually AFTER the charge. So what charge is currently being applied?
