The way I have seen it explained is that while VISA holders like you have the same free speech rights (the Constitution doesn't distinguish between citizens and non-citizens), immigration law is governed by different standards. So while the 1st amendment says you can't be fined or prosecuted in a US court for statements that are not incitement to imminent violence, you could still be deported. I still don't like the idea that certain people are restricted from expressing controversial beliefs via threat of deportation. Seems counter to the spirit of the 1st amendment, which is to encourage a free and open society. But I suppose I see the logic in it.
