Let me stop you there. The penalty for being in the US without proper paperwork is a civil offense. It isn't a criminal offense. The penalty for crossing the border illegally is a criminal misdemeanor trespassing charge. Now look through federate statutes and see if there is a federal minimum sentence for these charges being convictions. If there isn't a federal minimum that isn't "deport" then guess what.... Judge's discretion. There is no law that says "the minimum sentence for this violation is deportation". A lot of judges aren't psychopaths and sees a person with no violent criminal history just looking for some work as not some evil person who needs to tossed out. So you are just making crap out of thin air. There is no federal minimum sentencing for these violations and misdemeanors.
