Fluoride in drinking water poses enough risk to merit new EPA action, judge says

NEW YORK (AP) — A federal judge has ordered the U.S. Environmental Protection Agency to further regulate fluoride in drinking water because high levels could pose a risk to the intellectual development of children.

U.S. District Judge Edward Chen cautioned that it’s not certain that the amount of fluoride typically added to water is causing lower IQ in kids, but he concluded that mounting research points to an unreasonable risk that it could be. He ordered the EPA to take steps to lower that risk, but didn’t say what those measures should be.

It’s the first time a federal judge has made a determination about the neurodevelopmental risks to children of the recommended U.S. water fluoride level, said Ashley Malin, a University of Florida researcher who has studied the effect of higher fluoride levels in pregnant women.

She called it “the most historic ruling in the U.S. fluoridation debate that we’ve ever seen.”

The judge’s ruling is another striking dissent to a practice that has been hailed as one of the greatest public health achievements of the last century. Fluoride strengthens teeth and reduces cavities by replacing minerals lost during normal wear and tear, according to the U.S. Centers for Disease Control and Prevention.

Last month, a federal agency determined “with moderate confidence” that there is a link between higher levels of fluoride exposure and lower IQ in kids. The National Toxicology Program based its conclusion on studies involving fluoride levels at about twice the recommended limit for drinking water.

The EPA — a defendant in the lawsuit — argued that it wasn’t clear what impact fluoride exposure might have at lower levels. But the agency is required to make sure there is a margin between the hazard level and exposure level. And “if there is an insufficient margin, then the chemical poses a risk,” Chen wrote in his 80-page ruling Tuesday.

“Simply put, the risk to health at exposure levels in United States drinking water is sufficiently high to trigger regulatory response by the EPA” under federal law, he wrote.

Findings
The NTP monograph concluded that higher levels of fluoride exposure, such as drinking water containing more than 1.5 milligrams of fluoride per liter, are associated with lower IQ in children. The NTP review was designed to evaluate total fluoride exposure from all sources and was not designed to evaluate the health effects of fluoridated drinking water alone. It is important to note, however, that there were insufficient data to determine if the low fluoride level of 0.7 mg/L currently recommended for U.S. community water supplies has a negative effect on children’s IQ.

The NTP uses 4 confidence levels - high, moderate, low, or very low - to characterize the strength of scientific evidence that associates a particular health outcome with an exposure. After evaluating studies published through October 2023, the NTP Monograph concluded there is moderate confidence in the scientific evidence that showed an association between higher levels of fluoride and lower IQ in children.

We found that women with higher fluoride exposure during pregnancy tended to rate their children higher on overall neurobehavioral problems and internalizing symptoms, including emotional reactivity, anxiety, and somatic complaints by age 3 years. Furthermore, each 0.68 mg/L increase in MUFSG was associated with nearly double the odds of total neurobehavioral problems being in the borderline clinical or clinical range. Women with higher MUFSG during pregnancy also tended to rate their children higher on Autism Spectrum Disorder symptoms. The effect sizes observed in this study are sizable considering the relatively low urinary fluoride levels of participants.

The study found that exposure to drinking water fluoridated at 0.7 mg/L throughout pregnancy was associated with symptoms of executive dysfunction, including poorer inhibitory control, and decreased cognitive flexibility among children aged 3 to 5 years.

If Trump has his way he would dismantle the EPA completely. The petrochemical agency would love to save money to have less regulations on the toxins they spew into our air, land, and water. Trump's their man, and they will use their money to bribe him into doing as they wish, just like the NRA. Not good for places like Houston surrounded by these plants that already get by with violations left and right, but keep on doing it.
