You didn't address the part about how you show that an act was not an official act and therefore prosecutable. In the hyperbolic example of kidnapping electors, maybe you can manage to do that. But in a more real life situation, such as one in which the president conspires with other high officials and members of his Administration to undermine an election and persuade Congress to declare him the winner even though he lost, a prosecutor would be hamstrung in demonstrating that the conspiracy was not an official act given SCOTUS rules on what evidence can be relied upon. Or am I wrong about that? That state of affairs means the onus for deterring the president from committing crimes rests entirely upon the shoulders of Congress, roughly half of whom are members of the president's party. Despite the legal elegance of having Congress play the role as the check on executive malfeasance, given what we've seen about how the parties actually behave in impeachments isn't this a recipe for a complete disaster?
