We don't have any confirmation of that.

Grayson points in the direction of the kitchen at point, but never says anything.

It appears the recording officer may have non-verbally suggested she deal with the water, as after he looks into the kitchen then back at Massey she says "I'll go deal with this" then goes to the kitchen to which the shooting officer says "we don't need a fire in here" (showing agreement with her dealing with it).

No one tells her to pick up the pot. She could have simply turned off the stove.

Her family has confirmed she suffers from schizophrenia. The officers questioned her if she was "OK mentally" to which she replied "Yes, I've taken my medication".

Her saying "I rebuke you in the name of Jesus" makes a lot more sense given this. Means she could have heard/seen things that were not there.

Yes scalding hot water is a threat but it's not an easy weapon to use especially at a distance of several feet. The 8'- 0' would have to consider there is a counter inbetween them. It would be impossible for Massey to quickly close that distance to attack Grayson and further in the video she doesn't move to close the distance. It's Grayson who approaches Massey.

I just watched the video again and don't see him stepping back. He appears to rock back which would be consistent with the recoil of firing two shots.
I'm not a lawyer or understand IL law but there does appear to be malicious intent. He draws his firearm right after she says "I rebuke you in the name of Jesus" at that point she is standing at the sink and he is standing at least 3' from the peninsula counter. Based on standard cabinetry and fixture sizes that likely puts Grayson 9' from Massey with a peninsula counter in between. At that moment she is unlikely to be able to hit him with water or charge him.

It's about what a reasonable person would do in a self - defense situation. He already has his weapon drawn and is several feet from her with a barrier between her and him. I'm not a firearms expert but have shot pistols and the effectiveness of a pistol is not greatly diminished from 6' to 9'. Also he has a partner there who he could've asked to keep cover at a distance while he proceeded to move in. He doesn't but moves in himself and then proceeds to fire.

Most people in here believe it will be 1st degree murder so we will see. One thing is for sure that this trial will garner a lot of attention and I don’t want our cities to be burned down again just because of some verdict.

To add my understanding that I've heard from LEO is that when you draw your firearm the decision that deadly force is needed is already made. Grayson draws his weapon while she doesn't appear to be physically threatening him and does based on her words.

What exactly would have constituted a "physical threat" to you?

I would have felt threatened in that situation.

I would not feel comfortable anywhere near someone with a pot a boiling hot water who had just said what Massey said.

I would not but this is why "reasonable person standard" is a subjective standard. As an LEO with a taser and a partner on scene I think this will be a difficult argument that Massey was an imminent threat that required deadly force.

This goes again though to a frequent argument that LE make. That every use of deadly force is justified because the suspect is an imminent threat. It was the same argument made that George Floyd because of his size was an imminent threat even though he was down, cuffed and with three LEO holding him down.

How do you define near? As stated before when Grayson draws his weapon Massey is probably about 9' away from him.

I don't know the answer for this but it would be a interesting experiment to conduct. Stand 9' from someone with a counter between and try throwing a pot of water at them and see how much actually gets the other person wet.

Certainly from the distance Grayson was to her qualifies.

Have someone stand 10 feet away from you and see how quickly they can close that gap before you can put them down with a pistol.

I still haven't watched the moment she was actually shot.

but when the video was first released and the stills showed she was throwing the boiling water, I was thinking the cop could get less than 1st degree but still jail time. less because he's the one that approached and escalated for no reason off a simple statement, although I can see how one would take that statement as a threat, he still went from 0 to 100 unnecessarily. and of course he isn't going to shoot her in the foot, and utilizing the taser could have had the same effect with water right there.

at the end of the day, he is in custody and a trial is coming so there should be no rioting. a just as equally big of a story is the fact he was still able to be a police with the record he has and unfortunately he ain't the only one like that out there. needs to be a full clean sweep of cops with bad records and tbh should all be publically viewable if you live within the jurisdiction since they're public servants.

So picking up a pot is now a reason to shoot her....

They have proper enough distance between her that even if she decided to throw the hot water on them.. It might hit there toes...

I have family members with HPD, Harris County an FBI so I support and back Law Enforcement, but your reach right now is BS on him murdering this woman.

None of us have, because that video does not exist.

    That doesn't exist, either.

I see you still fueling BS.. That pot was full of water.. she could barely hold it up... She has the pot by the handles with a towel.. No way in hell she can throw that water that far..

This still gives him no right to kill her..

    Don't be duplicitous.

You know that is not the entire reason she was shot.

Watch the video again. It doesn't appear that she is throwing boiling water. She is obscured at the very moment of shooting but leading up to it she doesn't appear to be making a motion to throw water. Also from the stills @DonnyMost posted it looks like the water is on the floor flowing from behind the counter. That would be indicative of the pot and water falling to the ground from her hand rather than it being thrown at Grayson.
I think if there was going to be riots they would've started already but if there are it might not just because of this. The George Floyd riots were specifically because of George Floyd but more generally because of several other cases including Philando Castillo and Jamar Clark shootings that happened in MN where the LEO wasn't convicted.
