I would like to think so but given the recent rulings from the highest courts I'm having my doubts.

The path forward: Cannon is overruled by the 11th Circuit. Trump will appeal to the SCOTUS, which will slow walk their decision, until way after the election.

+Thomas. I'll repeat here what I said 2 weeks ago. Got the timing wrong.

@JuanValdez, others -- yall are going to love this one.

Thomas, in his lone concurring opinion in the SCOTUS Trump immunity ruling, gave Judge Cannon a "legit" reason to dismiss the classified document charges against Trump. He added a section that questions if Jack Smith was lawfully appointed (Cannon has yet to rule on this but many felt she wouldn't go that far). What's striking about this (or not at all) is that there was no briefing about this, and it has nothing to do with the Jan. 6 immunity case.

Prediction: Cannon will dismiss the classified document case right before the election, giving no time for an appeal to reverse her decision, boosting Trump's talking point about bogus charges.

    23-939 Trump v. United States (07/01/2024) (supremecourt.gov)

It is difficult to see how the Special Counsel has an office “established by Law,” as required by the Constitution. When the Attorney General appointed the Special Counsel, he did not identify any statute that clearly creates such an office.

Pretty remarkable to disregard decades of settled precedent by latching onto musings in a concurring opinion. Much like originalism, that isn't following the law: it's making up justifications for a pre-determined outcome.

Her removal is unlikely because she based her ruling on legal reasoning provided by Justice Thomas. Without Thomas's opinion, removing her would have been straightforward. But now they lack a compelling reason to do so, at least regarding the legal merits of this specific ruling (disregarding her other decisions).

While it's true that Thomas went out of his way to offer her this legal justification, as a sitting Supreme Court Justice, his legal opinions carry significant weight and will continue to do so throughout his tenure on the Court.

This situation now points to a troubling development that, while no longer surprising, is deeply concerning: the partial co-opting of the Court system. It represents yet another blow to the integrity of our republic.

The Constitutional crisis is here. The coup never stopped.

The nation's elite media and the older class of national Democrats thought we were through the woods in 2021 - they underestimated the coup plotters. Then their bosses decided a coup was good content.

    Here we are.

Well, Clarence Thomas will be there...

I do trust the justices to make the right choice, except Thomas. Doesn't mean they won't surprise me though.

Good lord, why would you trust those people ?

They just invented the doctrine of Presidential Immunity to literally give Trump a get out of jail free card - as well as a million other horrible things.

These people have taken your trust and laughed at it for years, decades even, because they're appointed for life.

While Trump is going to be the focus now and historical, Mitch McConnell is the man that deserves so much of the blame for undermining our Judicial system. I don't expect Trump to be the person that ultimately topples our democracy, but I think the playbook has been set.

Outside of Thomas, I think they have some principle. As much as the immunity ruling concerns me, it really was a punt by the SCOTUS.

So they don't even want to see if there is any illegality in Trump's action?

The refusal to turn them on multiple requests and the physical presence of the documents in Presidents Bathroom has no bearing on this case at all? Is this judiciary telling an ex-president can take anything he wants and throw them anywhere he wants??

Or is there a different interpretation that I don't seem to get ??

This - the thing is that a lot of Trumpers are going off about #winning but fail to realize that the door is no longer cracked open, it is off the hinges and in the garage. The politician that ultimately takes power and tries to topple our democracy very well may be from the far left, using the same decisions that have helped Trump.

Honestly, why would anybody worry about that?

The emergency is right now. Project 2025 is slated for - January 2025.

The "deportation force" or whatever Trump militia that ends up being formed is going to try to hurt real people, people you know, very soon.

The criminality that Trump - a traitor to his country - engaged in from 2016-2021 is set to resume (and actually has already resumed).
