No President has ever been charged with a crime for official acts. Not even Trump. Paying off a p*rn star before he was President then talking trash about her to others and talking about the scheme while President, again, not an official act. Trying to subvert an election. Not an official act. Keeping classified documents after no longer being President. Not an official act. Inciting others to take illegal actions, not an official act. Just because one claims it was an official act because they were President when they took the action, does not make it so.
This is one of the several problems with this ruling is determining what is official acts and what is not. Any sitting or former president who finds themselves in legal trouble will argue they were acting in an official capacity. For example following what Barrett warned about a President could accept a bribe to appoint someone to an ambassadorship And then argue that appointing ambassadors is an official act so this cannot be prosecuted.
I have a legit question. Let's say Joe Biden as Commander in Chief makes a clearly illegal order to a service person. The service person carries out that order because the Commander in Chief told them to. Would the service member be charged? (Now let's ignore pardons and the the President telling the DOJ not to prosecute.)

Impeachment isn’t a criminal process. A president can be impeached for something that isn’t legally defined crime or not be impeached for a crime. Also as we see impeachment doesn’t apply to a former president.
