If they were already here illegally, yes. But applying for asylum doesn't make an asylum seeker illegal.
Too bad maga republicans listened to trump and blocked the bipartisan bill that would have provided more border security than the Biden executive action that will be blocked in court...
The bill that was being negotiated in congress would provide billions to hire more agents and to install more surveillance software. You can't do that by EO
Biden did it for political reasons, which I think was an ill-advised and wasteful move. It will be shut down in court, just like when Trump did it. Once the court declares the EO illegal, would you support Congress passing a bipartisan bill to change how asylum seekers are managed, such as requiring legal entry?
The Supreme Court isn't going to rule it illegal. They were one vote away from allowing Texas to enforce its border laws. This will pass 6-3 or 5-4. Kavanagh hates migrants
You were also told Trump tried the same thing and it was blocked in court just like the ACLU is seeking to block this one on the same grounds. If precedent holds, the ACLU will win this case as well. This is the entire reason Biden tried to get law passed instead of going this route. You know this. You're just being a combative prick.
Temporary for certain circumstances has been done by Obama, Trump, and Biden. There are certain things that Presidents can do. Presidents cannot permanently shut down the border and cannot make law. I think you're smart enough to know this.
The Supreme Court already ruled a similar EO by Trump as illegal. Biden may have tweaked the wording, but essentially, it runs into the same law which explicitly states that regardless of how someone arrives here, once they are present, they can claim asylum and must undergo processing. IOW, they cannot be immediately deported without processing. https://www.scotusblog.com/2019/07/...ive-president-carte-blanche-over-immigration/ Beyond OT 2018’s immigration merits cases, the court brought President Donald Trump up short on his policies relating to immigration and nationality in two notable instances. First, in Trump v. East Bay Sanctuary Covenant, over the objection of Thomas, Alito, Gorsuch and Kavanaugh, the Supreme Court rejected the Trump administration’s motion to stay a district-court order enjoining the president’s proclamation under 8 U.S.C. §1182(f) that would have barred entry (and denied asylum) to anyone who entered via the U.S.-Mexico border other than through ports of entry.
Hey buddy.... Since then I'm not sure if you're aware but the court has lost a liberal and gained a conservative. If anyone wants to place a friendly wager to the tip jar let me know. Supreme court upholds the EO 5-4 or 6-3.
I should clarify that the Supreme Court didn't issue a ruling; they simply opted not to stay the case that invalidated Trump's EO, as decided by a federal court and the 9th Circuit. Another similar case challenging Biden's previous EO is still underway. This will be another one of them. The Supreme Court won't be considering any of these cases this year. Ultimately, after the election, interest in addressing the border politics wanes, and the issue is largely neglected (yet again), until the next election.
Kavanaugh just ruled that it was legal for Texas to implement their own border wall on federal land lol. He isn't ruling against this buddy. The Supreme Court will give relief to the government if a district Court overturns the EO and the government challenges it. Save this post and I'll quote you when it happens
I think its stupid that we have to play this political game, the entire country knows we need to re-do immigration but that's the job of congress, the EO`s are nice but they wont last and, in many instances, will fail. The fact that trump told the gop not to pass the bi-partisan bill should be a slap in the face to Americans who want the problem fixed but maga wants to use it as political gain.......................this is why we hate politicians. The gop is the party of law and order my ass, they vote as the cult leader spoon feeds them, they cant think for themselves it appears.
