Agreed, you can’t guarantee your speech to be accepted in the private sector. However, you and I both know that there is a line, for example saying “I support the dems or repugs or Israel” is not something you can be fired over. Your employer doesn’t have the ability to govern your life outside of work to the effect it doesn’t impact their business
As it pertains to political speech, the California Labor Code protects employees from adverse action on the part of their employer due to the employee’s political activities outside of work.
That statute isn't even applicable to this discussion. We're discussing speech one makes in public, not the rules an employer makes around political activity.
How brilliant. You even got TenneTucky "not my sister, just my cousin!" Roxran to "like" that post. Good on you!
It's what her lawsuit is relying on. It's the entire question that needs to be answered in this discussion.
Then she is in trouble because the law is clear that a company can not make rules regarding political speech (which I am not sure would even hold up in federal court as constitutional) - so she first has to establish Disney made a rule you can't share certain opinions on Twitter. It will immediately fall apart there. Note the law doesn't say you can't be fired for what you express on Twitter. Also is should be noted that comparing yourself to Jews being slaughtered by Nazis is not a political activity but rather a deeply offensive remark to anyone Jewish. Mocking medical policy is also not a political activity, it's piping in on health policy made by both sides of the aisle. She has no case here, unless she can get a Trump loyal-judge to hear her case and make up the law to give her a temporary victory for the right to grasp onto.
I agree with you in principle but the key thing there is how it impacts their business. If Carano was just a boom mic operator Disney might not care whatever she said on social media. That she’s on screen changes things and they probably feel that whatever she said would be interpreted by many as Disney agreeing or at least condoning that opinion. My own view is that while too much is made of association. Just because someone is an employee of a company doesn’t mean that the employee and company are in agreement over politcal or other views.
If you say Republicans are idiots and your Republican boss catches wind of that, you're going to lose your job. When you engage in vitriolic speech towards any group - minority, politically, or whatever - you put your employment at risk. That is true for everyone but Elon Musk. So you better be really rich and powerful if you want to be able to stay stupid things and keep your job.
Hmm Elon companies draw a lot of news over workplace discrimination and harassment. Her representation must be hardened pros over this
When Disney files their motion to dismiss, we will get to see the other side of the lawsuit. Disney may have had good reason to dismiss her. We will see. I would be shocked to find out that Disney did not run the dismissal though their legal department, before the actual dismissal. Huge unforced error if Disney did not.
That’s not what I said and you’re playing a strawman deliberately here saying anybody is an idiot or group of people can get you in hot water. expressing your beliefs in a respectful way aka your religion is not and protected by the constitution whether it be workplace of not . You don’t have the right to push these on others but saying you are of X religion or belief can’t be a reason to get you fored
You think saying the other side is prosecuting you like Nazis did the Jews is expressing yourself in a respectful way?
