The SC report is odd... he begins by saying Biden willfully retained documents, then much later in the report writes Biden did NOT willfully retain documents. Then contrasts that fact with donald trump. The SC goes to great lengths to point to lapses in Biden's memory. Which are valid observations and important to note in his report. But then concludes that if Biden were to sit in a trial, that he wouldn't be prosecuted because his memory? Leading to a description of Biden as a sympathetic, well-meaning, elderly man with a poor memory. He concludes It would be difficult to convince a jury that they should convict him — by then a former president well into his eighties — of a serious felony that requires a mental state of willfulness." Of course, there is no serious felony that Biden faces. So his supposition seems odd at the least, if not inappropriate and unfair to suggest.
As we all should know regarding various other cases state of mind and memory is a difficult thing to convict in. I’m sure Hur is frustrated by Biden’s answers which are very self serving and is expressing that. To me the bigger impediment to prosecution is that Biden fully cooperated and in any prosecution can present it as an innocent mistakes That’s also likely the reason why we won’t see a Mike Pence prosecution.
Hur says Biden is too old and his memory is too shot for a jury to find him guilty... The orange dude should try that defense at this point. Haley vs Newsom will be fun.
What about the part where you can't indict a sitting president? Not sure why we are even talking about whether charges are warranted. Wait till November to see if you're ever going to get a chance to decide whether or not to indict. We just went through this with the last president.
Right. Special counsel reports on sitting president potential misconduct is nothing more than a recommendation to Congress to impeach or not. However the special counsel statute that was written during the Clinton presidency does not allow the Special Counsel to write the report in the manner that is needed for Congress so the Special Counsel goes about it in a way that tries to make it obvious without calling it out. In this case it seems obvious to me Hur was telling Congress “don’t bother… no high crimes… but DEFINITELY send this to Sean Hannity”. While the Mueller Report is pretty obviously laying out a case to impeach with the section on obstruction. You cannot indict a sitting president but you can impeach via Congress and regardless of the outcome you can indict after they leave office (now official via the DC Circuit decision). So WTF are we even doing with this weird special counsel provision? It needs to be re-written specifically for more Congressional oversight than prosecution if the special counsel is directly investigating a sitting president.
I read them and don’t recall him saying that the 25th amendment should be invoked. as noted already several politicians and others use the “I can’t recall defense.” In fact Haley who you support has used that defense before. If that is disqualifying then we would have practically no one who could serve.
That’s also part of it. Also if the USSC rules in favor of Presidential immunity Biden could publicly hand classified documents to Xi Jinping and not be prosecuted.
His comment that despite earlier in his report claiming Biden willfully withheld documents then later in the report said there was no evidence of that. Or his comments how that differed from donald trump? Or are you only focused on the SP's comments about Biden's memory?
