Your definition of 3rd Degree Assault is incorrect. I don’t know what you are quoting, but it isn’t the New York Penal Code, which requires proof of an actual physical injury. @SamFisher quoted it correctly earlier.

oh boy that sounds like the old school definition of assault, back in the old days "assault" was just the attack on somebody, even if you missed or didn't actually touch them.
