I know it won’t happen, but an interesting buy low candidate: Trevor Bauer I was definitely against the signing at all costs until I saw his public comments on the saga. I do think as the facts come to light, some team will take a chance on him. Houston has opted to avoid PR nightmares since Luhnow/Osuna…so I doubt it happens. But we don’t have much room to make meaningful upgrades unless we trade significant pieces, so a flier on him could make some sense.
This is all Bullshit....... he waited to "drop this" until after he dropped the lawsuit and after the woman involved said she was done with it and wouldn't comment on it anymore. So he is able to present his "evidence" without anyone questioning it. I really don't want to dive too deep into it, but he had multiple women accuse him of sexual assault. He severely injured the woman at issue, and the independent testimony from the nurse that specializes in rape cases is that he raped and abused her, and that she could not do it to herself. He is a disgusting POS that still doesn't take ownership of his own actions - and the only reason that rape charges were not filed, is because it is very difficult to prove rape unless a woman immediately goes to the police. He sodomized her, punched her in the vagina and breasts and butt while sodomizing her why she was unconscious. He doesn't need to be anywhere near the Houston Astros and hopefully he never steps foot on an MLB mound again.
I’m not going to disagree with anything that you said, but as a former prosecutor who has handled, ~1000 sexual assault cases… the above sentiment is just not correct. I secured many convictions and tried many sexual assaults cases with delayed outcries. It is not as binary as you are suggesting, that because there was delay that no charges were presented or accepted. In fact, delayed outcries are often times consistent behaviors for victims of sexual abuse/assault. DA Offices routinely try cases without “rape kits”.
What I said came from the mouth of one of the DA's in California where this happened. I don't doubt your experience as a prosecutor. I did not prosecute sex crimes, I did other crimes - but I am repeating what one of the attorney's for the state of California said.
Any ADA who says a sex assault case wasn’t charged simply because of a delayed outcry is not giving the full story / full set of facts—because this is categorically incorrect. There have to be other aspects of the case that preclude a probable cause finding (a low bar, and what is needed for a charge to be filed), or or there facts that made the case completely unprovable beyond a reasonable doubt. Moreover, extraneous acts can be used in sexual assault cases in the guilt case in chief, which made the decision not to charge that more interesting. be that as it may, I didn’t know or forgot about extraneous events with other women. If true, then yes…don’t sign him and ignore my comment. For those calling out my character, lol. I was an extremely fair prosecutor, worked my ass off for the public for years, underpaid, overworked on weekends routinely to fight for victims (and also those charged) in Houston for many years…I’m an equally as proud as cases I dismissed as those I sought convictions on.
I think there are 2 ( out of many) very simple and important reasons I think we can all agree that Tyler Bauer should not be signed by the Astros for 2024. 1) the media and baseball fans around this country still to this day hope and pray for more reason to continue piling on the Astros and keep the negative publicity at the forefront. Bauer being on the Astros would be gasoline on their fire. 2) before any revelation about his personal life came to light, Bauer was a prick that publicly criticized the Astros and several of their players. He had a social media based scuffle with Bregman in particular. Character is important. Team chemistry is important. Based on Bauer's personality and character, regardless of the sexual assault issues he would be a net negative to this team.
As someone who's prosecuted in both CA and TX, I think you're not considering the difference between your jurisdiction (whichever that is) and where Bauer was charged (LA County). Especially under Gascon. Consider, too, that your filing standard (probable cause) may be theoretically true, but a DA shouldn't file a case they don't think they can prove BRD.
