It's a good question. The first ruling wasn't a fine. It found that the defendants (Trump, his sons, etc.) committed fraud and are liable, allowing this trial to begin.

This trial is now to determine if they should pay up to $250 million in penalties that the AG asked for.

Notice that Trump doesn't even seem to bother with defending, but instead is just playing his soundbites to the media and his supporters (who seem to be too stuck in echo-land and haven't realized he's already been found to commit fraud and still think he didn't do anything wrong).

I don't like agreeing with the MAGAs but I also agree there are no victims in this case. I really don't understand how James can ask for $250 million

Banks do due diligence and they are responsible for verifying property valuations. On insurance, wouldn’t higher valuations result in higher premiums?

I understand fraud is fraud but like I stated when this started nobody has sued the organization for fraud. She isn't suing on behalf of the state in terms of defrauding the state

I don't believe we can definitively say there are no victims resulting from this type of financial fraud. If inflated property values were leveraged to secure favorable interest rates on loans, the lending banks become victims by way of reduced profits. Lower bank profits then translate into lower tax revenues for federal, state and local governments, which impacts public services and citizens who rely on them. Another scenario is if true property values were underreported to reduce tax burdens. Again, this denies revenue to governments and has ripple effects on taxpayers and communities.

Regardless of direct victims though, allowing high-profile fraud to go unpunished risks normalizing the behavior. If companies and elite business leaders inflate valuations without consequences, it corrodes trust in financial systems. This could incentivize more fraud, distort economic data, and make conducting business more challenging across the board. An environment of unchecked fraud at the top levels can breed systemic misrepresentations that ultimately hamper economic growth and stability. While the letter of the law may not always require prosecutors to prove specific victims (In NY, it does not need to), the spirit of justice and deterrence of future harms should compel punitive action when major financial deception has clearly taken place.

Orangie should plea bargain for a hefty fine to keep his business license. I am sure NY enjoys benefits from the taxes his employees and businesses pay, so it would be a win for everyone. He is using this trial for free publicity.

in this scenario, the banks' stockholders, as well as bondholders, who are NY residents, are also victims of this fraud,

Banks are responsible for their due diligence. If a bank took the word of a borrower and not a certified appraisal you need to to start looking out for the grandma's and grandpa's with their money in the bank by looking at the and holding the bank at fault. Where can you get a mortgage without an appraisal?

Regardless the banks aren't suing, James brought this suit

It's not just banks; anyone involved in any business transaction is responsible for conducting their due diligence. However, the presence of due diligence doesn't guarantee that fraud won't happen. In this particular case, it has already been established that fraud did indeed occur.

If I were a bank that had been defrauded by Trump, I take the loss. Pursuing legal action against him would be a risky endeavor, given his strong support base. But even if Trump were an insignificant figure, my guess is banks typically refrain from suing as long as they aren't incurring losses, even if it means their revenue is lower than expected.

He loses his license, then he sells to someone else that will pay the employees and taxes.
