The U.S. Consumer Product Safety Commission (CPSC) has proposed a policy (pdf) that would remove nearly all existing portable gas generators from the market. The new rule restricts the amount of carbon monoxide that generators can emit by forcing these generators to switch off when they reach a certain level of emissions. Smaller gas generators would have to cut carbon monoxide emissions by 50 percent, and larger generators would have to cut emissions by up to 95 percent. Nearly all models currently available are expected to not be in compliance with the new standard. Once the proposed rules come into effect, manufacturers would have to comply with them in just six months, a process that usually takes several years. The rules would also ban manufacturers from stockpiling noncompliant generators before the new standards are enacted. In a June 28 press release, Susan Orenga, executive director of the Portable Generator Manufacturers’ Association, pointed out that CPSC’s proposal will “create a shortage of essential portable generators during regional and national emergencies because it will prevent the sale of portable generators that are currently available on the market.” “Furthermore, the timing of the CPSC’s proposed changes are particularly concerning, given repeated warnings that two-thirds of North America is currently facing an energy shortfall this summer during periods of high demand,” she said
Safety is smart, not madness. This was coming and long overdue, but with any regulation, there is usually a period for phase-in. Here is the docket if anyone is interested: CPSC–2006–0057. And here is some of the background on the proceeding. Here's what I think was interesting. The Commission issued a notice of rulemaking way back in 2006 to address the issue of carbon monoxide poisonings. Then they partnered wth a university to study the problem and possible solutions. Ten years later, in 2016 Staff (the Commission has 4 or 5 commissioners appointed by presidents and confirmed by the Senate who vote on rulemaking, but they have Staff, who are the employees who do the work) drafted proposed rules on requirements that could make generators safer. There was a comment period in 2016 where manufacturers and other interested parties submitted ideas, objections, tweaks, and other comments to the agency. No final rulemaking was issued then, but instead the industry instituted new voluntary standards in 2018. After a period of data collection, in 2022 Staff presented findings to the Commissioners. So now the Commission is issued an updated proposed rulemaking that builds on the voluntary standards from the industry (which were supposedly better than the ones in the 2016 proposed rulemaking). That came out in April and comments on this new version were due in June. The industry seems to lament that the comment period was too short, but warns of unintended consequences, like the overheating of generators. Next steps, Staff will review comments and propose a final rulemaking that incorporates the feedback they got and the Commission will vote on it. The current commission has 1 Trumper and 3 Democrats. Point of all that is: this is not a conspiracy to make everyone a slave to the communist electric grid in some climate change boondoggle. This started way back in the Bush Admin for totally apolitical reasons -- because people were running generators inside their homes and poisoning themselves with carbon monoxide. It's just boring bureaucratic stuff to make a product safer than market forces seem to be accomplishing. I did not see the portable generator industry say it was going to put them out of business -- their complaints are smaller and more nuanced, like it puts upward pressure on price and will depress sales; or that the number of lives saved is wrong because of incorrect assumptions. In other words, shareholder value may take a dip, but the industry will be okay and people will be able to buy (safer but maybe more expensive) generators.
