First, I didn't say anything about the debt ceiling. Second the 14th Amendment makes note that states that limit the rights of male citizens to vote can see a reduction in representatives. I notice that there is no real discussion of female voters - it is almost as if the Amendment is flawed on its very face - oh that's right women couldn't vote in the USA at this point in time. Maybe the Originalists very position is absurd on it's face... Beyond that, if I remember correctly the 14th Amendment dealt with the fall out from the Civil War and nothing really about the debt ceiling or federal spending in 2023 - regardless, the 14th Amendment does state that the validity of the public debt of the USA shall not be questioned. Also, maybe we should go back and look at Section 3 of the 14th Amendment and what happened on Jan. 6, 2021 - interestingly enough I don't hear many originalists discuss this - it is as if they are selective in their enforcement or claim of Originality. Very similar to those Christians and Muslims that rely on the exact text of their holy books as the actual word of God - Either way it is cute to the extent that it doesn't harm people.

Since we are in the thread about the debt ceiling and discussing the constitutionality of de facto raising the debt ceiling without Congressional authorization, I thought it was a relevant question to ask. Was the purpose of the 14th Amendment to allow unlimited borrowing without Congressional authorization? How is that absurd. The law at the time was that male citizens could vote. As such, it would not make sense to reduce representation because a state didn't let female citizens vote. If you tried to reduce representation based on such now, the text wouldn't support it (whether you read it from an originalist perspective - that it was intended to prevent states from disallowing emancipated slaves from voting - or a plain text reading). A better argument against originalism is an examination of the 1st amendment, or the 4th or 5th. Yes, and I have already said that it holds true. You cannot question the validity of the lawfully incurred debt. No one is saying treasury bills can be cancelled. I don't think there are any representatives who have engaged in an insurrection or a rebellion. There might be a few who have arguably given aid and comfort to enemies of the United States, but I wouldn't connect that with January 6th.

Debt ceiling might be a manufactured crisis, but the ballooning deficit is oh so real. I wish there was consistency and seriousness for addressing it, but politicians be politicians...
This is pure speculation but I think Kavanaugh would agree with the interpretation that the 14th would mean that the government has to pay its debt. Outside of some cultural war issue he certainly seems more willing to rule in ways that both favor the executive and maintain stability.
I think it’s more likely a deal gets made. Both McCarthy and Biden are showing a willingness to compromise on a few things.

I'm surprised you didn't expect this to happen. Republicans have leverage with the debt ceiling. Excepting some stunning victory before the SCOTUS with the 14th Amendment, this was always going to end with some concessions made. Biden's job was to make them as small and harmless as possible. By delaying negotiations and by getting public sentiment on his side he can minimize the concessions. But McCarthy cannot walk away from this emptyhanded and remain as Speaker. He might not even be able to keep his seat if he fails that utterly. For his own career, he absolutely cannot allow the debt ceiling to be raised without winning concessions, economy be damned. And I think Biden understood that and knew from the outset -- even planned -- that he would concede something at the 11th hour even while he was telling the public he wouldn't.
The big issue is who on the Supreme Court is trustworthy? I think roberts would join the liberals but do you trust Kavanagh or Barrett? Gorsch, Thomas and alito would 100000% rule against biden as they're for "limited" executive power. This whole thing is such bullshit. The media keeps framing this as its not hostage taking. It's bs that GOP can get away with this every time. Manufacturered crisis to make biden look bad and it's such childish bs
I don't think Biden intends to try the 14th amendment. As you say, the SCOTUS environment isn't favorable. If he was going to do it, he'd have started already. And he's not the kind of president who is about overturning decades of established practice with novel legal theories. I think he talks about it to underscore the offense of Republicans' debt ceiling brinksmanship to get public sentiment on his side. Sure, it's a hostage taking. It's also one of the few tools of the minority party to protect itself from majoritarian politics. I think Democrats need a better longer term strategy for how to deal with it. When they're the minority party they don't want to use it, and they seem to completely forget about it when we're not in crisis mode. I suggest the next time it comes up with a Republican president, Democrats refuse to raise it until some tax cut for the rich is rolled back. Some tit-for-tat might build a bipartisan appetite for getting rid of the thing altogether.
