Why would Warren Burger's interpretation of the 2nd Amendment be any more authoritative than other Supreme Court justices?
The most depressing thing about this thread is knowing nothing will change because money controls politics and the NRA is too powerful. It's so depressing when you think about the utter state of our society and how we can't react because our politicians are corrupt. We're a broken society
About 'a well regulated Militia being necessary for the security of the State'? It's right there in the text. About 'there is an unfettered rights to bear any type of weapon'? Which SC Justices have said that?
About that meaning there is no individual right to bear arms. Supreme Court justice both before and after understood that the 2nd Amendment protects an individual right to bear arms, even though everyone agrees that the security of a free State is protected by a well-regulated Militia. In fact, the framers of the Constitution recognized an individual right to bear arms, up to and including cannons, and called on those individuals with their own personal arms to take them up against threats like pirates. They also demonstrated an ability to specificy rights and restrictions belonging to entities other than individuals (Congress shall make no law, reserved to the states or to the people, etc.) No, about the 2nd Amendment protecting an individual right to bear arms. Once it is recognized that the 2nd Amendment applies to individuals (the right of the people), it is clear what limitation the 2nd Amendment calls for (shall not be infringed).
It's not that clear, since the right of the people to bear arms could be seen as conditional to the well regulated state militia. I think there are reasonable arguments to be made either way.
I own a ****-ton of guns, 40 or so. They are not "well regulated" at all. Yall are now the only people who know about them. Most are old and sentimental, collector's stuff, and have the firing pins pulled out, but there's a dozen or so bolt-action rifles, shotguns, whatever that are used for hunting and ranching purposes...nothing that can shoot more than 4 shots without reloading. I would be happy to register all of these, but nobody has ever asked.

Just a reminder that even Scalia wrote in Heller there is no unfettered right to bear arms and that regulation was Constitutional.
Are you still making an argument about letters of Marque and privateers? At that point the US government might as well have its own Wagner group and give them a letter of Marque to fight in Ukraine and pirate Chinese Merchant ships. Also to note that the Founders did use militia crush citizens militias and take their arms. Scalia disagrees.
Ban handguns and military arms. "well regulate" the rest (hunting, working, actual uses) Problem solved over several years.
No Supreme Court Justice AFAIK has said that there is an unfettered right to bear arms. The late Supreme Court Chief Justice Burger was right when he said, 'The gun lobby's interpretation of the 2A is one of the greatest pieces of fraud on the American people by special interest groups'.
