They won’t do it because you called them out. If you hadn’t, they likely would have, as bizarre as that sounds.

Pretty good article, really, about the legal details. He talks a little also about the partisan switcheroo I was feeling from this case already. There's the political alignment of the BLM protester and the conservative. But then the BLM protester is carrying a firearm, which I disapprove of and I think is asking for trouble. A conservative observer, however, likes to put himself in this role in their daydreams, the white knight exercising his second amendment right to protect himself and others while they exercise their first amendment rights. But along comes another armed man who is claiming self-defense, which they loooooove, and he's an actual conservative and not some dirty BLM protester. Now, they'll have to recast the white knight defender as a villainous aggressor to rationalize the self-defending conservative. Details about how the self-defending conservative looking for an opportunity to murder someone just get in the way. So I can see how Abbott can get some mileage pardoning a convicted murderer in spite of gun-right scruples about self-defense. Usually, it's the dead guy who can't prove he was acting in self defense.

For me, it just reaffirms my opposition to gun rights and the complete wrongheadedness of conservative gun culture. We'll keep getting these self-defense vs self-defense cases because we make laws that encourage people to do violence to others to keep our own selves safe.

solid take...its doubtful, but i hope the abbott-appointed board of pardons considers what is layed out here.

abbott is such a weak-minded political hack. he just goes along with what he thinks his base wants. maybe he expects the board of pardons to not recommend letting off the murderer and he can still claim that he tried.

also, the article mentions that the army explicitly forbids active duty from being around protests.
"Further, there was evidence at trial that as an Army sergeant stationed 70 miles away at Fort Hood, he was explicitly prohibited by his command from going to Austin, presumably because of the risk of confrontation with protestors."

it reminded me about a time when my cousin was in basic training in san antonio (air force) and i met him for lunch. we were walking downtown and the most direct route was through some protest/march that was going on. he said he couldnt go down that street because of the protest. he wasnt even in uniform, but said he could get in trouble if he was seen or if some incident happened while he was there.

I said we should just give everyone personal bombs and go with the MAD strategy. If somehow it doesn't work, there won't be any court cases.

Being the aggressor towards someone and then using a gun to kill someone while claiming self defense for fear of one's life is one of the stupidest thing about our country.

I'm pretty confident that most if not all black men using that sort of defense will never get away with it in our fked up justice system.

I guarantee you if this guy gets away with murder here, these types of incidents will sky rocket. Once a person knows they can instigate someone into a fight and then shoot them, all hell will break loose and Abbott will be issuing a lot more pardons for murderers than he is now.

This has the potential to devolve into a lot of violence because if people feel they are being threatened they know they have to shoot first before they get shot.

Like imagine if u provoke someone into drawing their weapon, u can literally gun someone down and claimed u fear for your life/self defense.

This self defense bs and swatting are a few malicious ways u can use to end someone's life in this stupid gun crazy country

This is why I’ve consistently warned going back to Trayvon Martin that self defense isn’t about putting yourself in danger.

Yes you absolutely have the right to defend yourself and others in the face of an immediate threat but going out armed deliberately looking to confront bad guys is a terrible idea. That also includes going to a protest openly carrying.

Most of self defense is about not being in a situation where you have to physically defend yourself.

What makes this even more despicable is that if it was the BLM guy who had drove into a MAGA protest and the same exact thing occurred, Abbott wouldn’t be rushing to issue any type of pardon

he heard none of the evidence presented at trial…this was a unanimous conviction

Why even have a jury or justice system?

this is lawlessness solely based on being on the same “team”

watch, the right will make this convicted murderer a celebrity…u can expect a bunch of TV and podcast appearances from him
