Because a non-compete agreement has value, it is essentially a property right. Being deprived of that right is a taking. Takings by the government require due process and compensation. Not providing due process and compensation is a violation of due process.

I don't care what states things happen in. I live in California, which is the bluest of blue states. Things that happen here affect me, a libertarian, even if they are pro red or pro blue.
