    Falsifying a business record isn't the crime, it's the REASON behind falsifying it. If you falsify a business record to avoid taxes, then you pay a tax penalty and that's it probably. If you falsify a business record to launder money, that's very serious and you're going to go to prison. In this case, if Trump falsified records to avoid campaign finance laws, he will be in big trouble. It is cheating to win an election, and that should land you in prison. Republicans have screamed lock her up as a chant for many years, now it's time to honor that when it applies to one of their own.

    I think we’re both correct to some extent,.. falsifying a business record in New York IS a crime, either a misdemeanor- second degree or a felony first degree if there was a added offense as you mentioned as a REASON behind falsifying it -

    The odd thing about the Stormy Daniels case is that if Trump had known then what he knows now -- that nothing can really dent his popularity with the GOP base -- he would have openly bragged about banging a p*rn star while he had a baby son at home. Hell, maybe he wouldn't have even had such a close election with HRC.

    He didn't go on TV crying when 3 children and 3 adults were just killed in a school shooting. Yet he was literally crying and begging people to give Trump money on National television. This man has no morality.

    I am positive that the DA would not serve an indictment to an ex-President over a misdemeanor. The issue isn't falsifying a business record, that is what I meant by it not being a crime. I should have clarified - it's not a crime worth mentioning.

    There clearly is felonies here, and I am sure we will learn more once everything is unsealed.

    Assume innocent until proven guilty, let's not forget the saying you can indict a ham sandwich- proving a case is something entirely ..but we
    I disagree that the falsification of a business record is not an issue. That's the whole crux of the legal reasoning to indict

    We have not seen the indictment, so we can not assume what the reason is - although it would be silly for all this for mere misdemeanors. That's a deduction, not an assumption. Furthermore, there's a lot of hints that it involves illegal campaign contributions, and the attempt to hide those contributions by falsifying business records.

    Anyway, we'll see soon enough.

    Yes Trump is innocent until proven guilty and an indictment isn’t a conviction. Why not then allow him to have his day in court and present a vigorous defense instead of calling for death and destruction? Why go on and on about the politicization of the DOJ and state prosecutors and instead allow the system to proceed?

    What's fascinating is that people are claiming the indictment is out of control democrats looking for political revenge. What they fail to mention is that the indictment is from a grand jury - a bunch of average citizens who have looked at the evidence and determined there is enough evidence to move forward on like 30 crimes!
