To be clear, the bill proposes to remove the distinction between the homicide of a pre-born and a post-born person. So an abortion would be prosecuted as a regular homicide. There is an exception for preserving the mother from death or great bodily injury and a provision to protect a doctor if he's trying to protect the mother from death or great bodily injury. It starts from the moment of fertilization. The death penalty is a theoretical possibility because its on the table for murder convictions in the state. As I understand it, SC provides for capital punishment if a murder charge is accompanied by an aggravating factor, such as murder during a robbery or a rape-and-murder. But, one of the aggravating factors is murder of a child under the age of 11 -- which would apply to all abortions.

Yeah it's a terrible bill from my point of view, firstly for banning abortions, secondly for being a complete ban all the way to fertilization, thirdly for punishing the mother, fourthly for treating it with the same gravity as the murder of a born person, fifthly for allowing capital punishment as a theoretical possibility, and sixthly for casting a pall over the provision of healthcare by chilling even nominally legal abortions. But it hasn't been passed yet. Most bills don't get passed, but people are always posting proposed dumb bills and fretting over the future. And of course, posting them and fretting over them is part of the process of killing bad bills. But still, have some perspective; this bill has some hurdles to jump to become law.

2023-2024 Bill 3549 Text of Previous Version (Dec. 15, 2022) - South Carolina Legislature Online (scstatehouse.gov)

Republicans are all about deregulation. They don't care about workplace safety, the common people, or the environment. That's why the big chemical plants, NRA, and rich corporations feed their pockets. Making profits over people's health and safety is the Republican way. Don't let them pretend they give a damn about the working class.

We see where the majority of Republicans stand on abusing children with disabilities. Rep. Jim Olsen just cited Proverbs: He that spareth his rod hateth his son. Rep. Jim Olsen is a horrible man to quote the Bible in justifying using corporal punishment on children with disabilities. I wonder if the majority of those Republicans also approve of beating people in nursing homes.

What they are actually pushing is treating children in utero the same as children who have been born. Just like you can get the death penalty for killing a baby 10 seconds after it is born, you can get it for killing a baby 10 seconds before it is born. I, for one, oppose the death penalty, but the death penalty is not really part of the law, that is just one of the statutory penalties for murdering a child in South Carolina.

I understand the logic that life begins at fertilization (zygote) and that the death of a zygote and onward is the same as the death of a child. Therefore, any actions that cause the death of a zygote should be considered in the same way as the death of a child. Penalties and punishment should then be applied consistently and equally.

I judge this viewpoint as religious extremism, and it is unsurprising to see legislation based on this logic following the Court's overturn of Roe.

So what if the man pays for the abortion. Is he charged with Accessory before the fact and sentenced to death as well?
