    It looks like he shot him one last time within a second of picking the gun up.

    I don't think any reasonable person would have been able to tell that was a fake gun that quickly under such circumstances.

    It's easy to MMQB this stuff.... but if someone points a gun at me and other people around me, I am going to assume they are a lethal threat to me and others until they are dead or in custody.

    I don't think it's reasonable to expect people to 'secure' a scene, apprehend a guy, or take any chances when assault with a deadly weapon has happened.

    Do we wish that these circumstances ended without violence? Yes. Do I think that having the restaurant patron put in prison or otherwise punished is a benefit to society? No.

    Maybe an "abuse of a corpse" charge is a fair compromise.

    Enjoy 5+ years of lawsuits, media, etc regardless if what he did was legal -- just not worth it unless it's truly life or death. Has LE found him yet?

    This is the first scenario that came to my mind as well.

    IIRC the difference was that the store clerk donwed the guy, called the cops, went over to the perp, picked up his gun, walked away... (possibly reloaded) came back, looked him over, and then put two more in his head.

    Premeditated VS. Heat of the moment.

    Robber effed around and found out. Shooter should not be charged, he stopped a violent crime by a criminal brandishing a firearm (albert fake) and threatening people. The more civilians are armed and stand up to punks like this, the more these criminals will actually be deterred from committing violent acts on the public. This robber has been in and out of jail like a revolving door. If the justice system can't keep people safe, citizens will. Bravo.

    My wife works at the school his kids go to. They nor the mother are handling it well at all. Such a sad situation he put himself into that cost him his life and who knows how it will affect his family as they try to move forward.

    How much is heat of moment? The shooter in this case disarmed the robber and then shot him again. The robber is both unconscious and unarmed. It might not be premeditated but that is why there are charges of 3rd degree murder and manslaughter for killings made in the snap decisions.

    From first shot to last was 7 seconds. From penultimate shot to last shot was 3 seconds. From the time he grabbed the gun to the last shot was less than 1 second. Hard to say someone has a lot of time to think much through in that timeframe.

    Do you think it is reasonable to expect the defendant to know that for certain or expect to feel safe given the events as they transpired? I don't, and I don't think you're going to find a jury that feels otherwise either.

    Like I said before, it's easy to MMQB this... 'he was leaving', 'he was unconscious', 'he was disarmed'... all of that is speculation, and even still, a civilian in such a situation is not to be expected to disarm and neutralize an attacker with non-lethal force.

    As stated, I would not feel safe inside that restaurant until the attacker was in custody (subdued by multiple people) or dead so I can't fault the defendant for what he did.

    I'm late to the party. Finally watched the video. I'm not buying the overkill argument. I mean, it was overkill, but he took all his shots within something like 5 seconds. That's all heat of the moment, even the unnecessary shot after picking up the gun. And so far as I know, he had nothing to do with creating the situation in the first place. I'll be very surprised if he's charged with anything at all.

    However, I really don't like the hero narrative people like to put on these situations. The robber forfeited his safety when he threatened people. But, this guy shot a man dead. I won't lionize that.
